As protests continue across California, Governor Arnold Schwarzenegger still has hope that his state will once again allow same-sex marriages.
Schwarzenegger seems hopeful that the California Supreme Court will overturn Proposition, the newly passed ban on gay marriage.
"It's unfortunate, obviously, but it's not the end," Schwarzenegger said in an interview on CNN this morning. "I think that we will again maybe undo that, if the court is willing to do that, and then move forward from there and again lead in that area."
He also said that Proposition 8 should affect the gay couples already married in California when same-sex marriages were legal.
Governor Schwarzenegger has previously opposed gay marriage and later decided that he didn't care if it was legal or not. It looks like someone has officially decided to support same sex nuptials!
This guy is another phony conservative. Why vote on anything?
Not true, Jeff. The California Constitution can only be amended if both houses of the California Legislature vote by supermajority to pass an amendment to the people via referendum. Then the people must pass the referendum into law via majority.
Instead the organizers of Proposition 8 set it up as an initiative, and an initiative cannot be used to amend the California Constitution. When this challenge to the initiative hits the state courts, it is an open and shut case to overturn it.

I heard the same analysis regarding the fact the not only did California voters vote to ban homosexual marriage, but the law would become part of the California constitution. I think only the supreme court can overturn it, but I’m not sure even they can if the law is part of a state’s constitution. Are there any constitutional attorney’s out there who can answer this question?

Once Obama gets his Supreme Court in order I expect a flurry of gun cases to come before the court.
What is a state just gets out of the marriage business entirely and said whatever happens is between the couple and their religions?
Are states in the marriage business for revenue purposes?

In 1924, Congress passed the Simpson Act which closed the floodgates of immigration that had been open since the Founding. Along with Simpson, Congress passed a law handing an unfunded mandate to the states to track births, deaths and marriages via both recordkeeping and official certificates.
The prime mover for this law was the Federal Reserve. (Don't ask me why, because there is no reason I can come up with that does not quickly move into tinfoil hat territory.) This is why states are on the hook for such stuff.

Didn’t see it on CNN web site. And I can’t stomach actually watching CNN, so will have to wait and see if major California newpapers or AP picks it up tomorrow.
Not just once but twice -- this is the second time Cal voters said no to same-sex marriage. But the radical gays don't care about anything except getting their way. That's why they're out in the streets protesting and vowing to "boycott Utah."
