After a heated, divisive campaign, fueled by a record $73 million of spending, California voters Tuesday were backing Prop. 8, which would change the state Constitution to ban same-sex marriage.
Six months after the California Supreme Court cleared the way for gay and lesbian couples to legally wed, the estimated 18,000 same-sex couples who took advantage of the landmark decision now are wondering if they will be the last.

It could still fail.
Not to be the wet blanket here, but only 25% of the precincts reporting and the amendment is only leading 53/47. CNN hasn’t called it for Yes at this point, and I’m concerned with the current support level.
IT HAS NOT PASSED YET. Returns here in CA can be very volatile as big blocks of city votes come rolling in.

It’s a Constitutional Amendment, so I don’t know what the procedure is now to overturn it.
I honestly don’t know — I would just hope it would take a look more work than the last Proposition we passed.
Yes, thank God. But make that three rays - Arizona passed their marriage amendment by a landslide. And Florida's looks like it will pass easily - even with a 60% required vote.
It is schzoid isn’t it? My husband and I vote across the board conservative and I can not even grasp how one can vote Yes on 8 and Yes on Obama. It is absolutely disconnected.
Latinos — they won both ways, free citizenship and socially conservative value.
It’s very difficult, close to impossible in fact, for a court to overturn a state constitutional amendment.
That being said, I’m sure they’ll try.

This is actually BAD news. I’ve seen lots of propositions look promising at this time at night, and then go down as the big cities reported.
It needs a bigger buffer than this to be safe I’m afraid.
The same court that sat aside the original marriage ban will likewise set this aside. As I understand it, California makes a distinction between a Constitutional Amendment, and a Constitutional Revision. The court will use that as its basis, saying the incorrect procedure was used and that only a Constitutional Convention could “take away” pre-exisitng rights. In other words it’s Lucy pulling away the football as Charlie Brown kicks.
I doubt they can sell the idea of a Constitutional Convention. Particularly not in the new political reality.

The scumbag Democrats will challenge “Prop 8”in court and get a permanent “stay”.
In other words, this proposition will meet the same fate as every other proposition passed by California voters. And the people will simply bend over, grab their ankles, say “thank you”, and then go back to sleep....

They are stupid! I have a friend from CA who said that people were voting *for* Prop 8 because they were *for* same-sex marriage!
