"I had no recourse, but my Friend I think you can file suit."

I've just been through it re a very legit, very documented sexual harassment w/retaliation suit. I lost a fifteen year job and many lifelong friends. The process is VERY stressful and takes a high emotional toll.

It's easy for others to say "You should sue!" but actually going through it is difficult. You must have support from family and friends, otherwise you'll fold. Be prepared to get verbally trashed, also. Not for the faint of heart.

Btw, at the time of my written complaint about the criminal harassment by the black coworker, I stood up in morning roll-call and delivered a 4-5 minute tirade of warning to everyone that I was sick and tired of hearing “white boy” this, and “white boy” that; that coworkers and supervisors who perpetuated racial and political diatribes against whites in the workplace were on notice, that if anyone dared come after me for speaking out and blowing the whistle, they could just take their best shot if they chose to...I went on at length about how all the stuff about “protected classes” was absurd to me when the law says we are all supposed to have equal protection, etc.

I really was surprised at how the words just came, and at my own forcefulness in saying them. But I’d just been fed up, and I basically was throwing down the gauntlet. Life is too short to not just make a stand from time to time, for what you believe in your heart to be right.

I don’t think anyone in that room had EVER heard a white person actually stand up and say out loud what so many whites are utterly afraid to say—that the climate of anti-white hostility in the workplace that is so ardently supported by management with all their “diversity” programs, etc., was cause for my utterly declaring war on anyone who continued to make certain types of comments, etc....their shock and fear, and my firmness, was reinforced by the fact that I’d prepared a criminal complaint against one of them, and that management was absolutely horrified that I’d actually go through with filing charges against the person—they were so concerned about the situation going over their heads and beyond their desire to just handle it at the unit level, to corporate level and the police, that they just let me speak uninterrupted and basically thereafter treated me with total reverence. I got promoted to supervisor soon after the other guy was fired.

It these sorts of things really start to happen we need to have in place a lexicon of code phrases that mean one thing to the Obies and something distinctly different to us. But maybe that is being paranoid.

I worked for a place that closed very suddenly. A lot of the employees who were now out of work filed Worker’s Comp claims because of ‘trauma and depression’ they suffered. They got doctors’ notes and psychotropics to back up their claims.

It worked for them. Maybe you could try that too.

You were a dumb ass to voluntarily tender your resignation. Make them fire you, dammit! You’ve just made the job of their attorney much MUCH easier if you pursue any sort of legal remedy. Do everyone a favor and name your employer. You have nothing to lose whatsoever. Who was it?

I really needed to be called a dumbass right now.

It's 4am and I can't sleep. And if you would have paid attention, and read the previous posts, you'd know my employer was Dish Network.

And thanks for your "support".

Hire a labor attorney and sue for mental harrassment. You should never resign - make them get rid of you so you can collect unemployment.

She seems to have a great case. It's going to take time, but she will get some big bucks in the end. Under the apparent circumstances, she has a great chance of getting unemployment, and should do so. She also has a civil rights action against the employer under the First and fourtheenth amendments.

I would have stayed and fought. My daughter wanted me to take this to the press, but who would listen, except maybe Fox News. And then there's the the possible repercussions to my family, my children and grandchildren.

Find a civil rights or employment lawyer. They can get some publicity wit ha press conference or by filing a lawsuit if the company doesn't come to their senses.

“Canadians” is being used in some workplaces to refer to a certain demographic group. Take a wild guess.

I used to work at IBM...it was the same situation there. Of course, IBM has nothing to brag about these days other than their numerous diversity awards. My new job isn’t much better.

You should read Sun Tzus The Art of War. And study it hard. You won't be terrorizing the weak minds around you for fun anymore. You will think like that Chinese warrior did thousands of years ago. Read up. He was Gen. Patreaus in his time.

Good advice! There are many translations of The Art of War. I remember one book that has his text and then someone wrote essays about how Sun Tzu's philosophy can be applied to contemporary situations (your job, relationships, etc.).

The people who post that you should have documented everything to prove to your tormentors that you are right and they are wrong in order to make them be fair is completely wrong. You cannot expect to convert people and make them act fair. Life is war and you cannot fight the machine on its own terms. Although it may be too late for your job, you can apply this idea from Sun Tzu in the future - use your enemies' resources to your advantage. For example, if you are in a job where people are abusive but you can get marketable training and experience, then you can take the training they paid for and eventually get a better job elsewhere.

Do try and see if you can get unemployment. It is possible that your former employer has a bad reputation about unemployment claims and they might not even fight a claim - it is worth a try. I know people are telling you how simple it is to not accept abuse and how easy it is just to find another job, etc. I know it is difficult, especially when such a "change" is forced upon you. I have lived through some very precarious situations and I know it is not easy. I have been in situations where my enemies treated me like a doormat but at the same time I used them (or rather, their resources) as a stepping stone to a better job. It was hard to hunker down and be quiet while I saw unskilled people promoted over me. It was hard, knowing that I was very productive and did quality work while I was being taken for granted and slackers were rewarded. And it was painful to temporarily accept abuse, even knowing that in the long run those people were nothing to me and I would soon free myself of them. Someday you will be so glad to be free of those jerks but I know now that does not put food on the table.

Political affiliation does not rise to the level of protected class for discrimination purposes - which really sucks.

I was just thinking about that... Imagine what would happen if you fired all the Obamites in your office. If there were even a handful of blacks in the office, they could get you for racial discrimination, and probably a lot more.

I had not heard of this “Canadians”. I like it though. In Swing Kids (movie)the youth who did not go along with the Hitler ideals, were bound together by Swing Music. They would say to one another “Swing Hile”.

If you have teens I recommend this movie which shows how it is to be under extreme peer pressure.

RE: “I wonder if you have some sort of discrimination lawsuit.”

If she has a witness to what was transpiring, I’m sure she has legal recourse. And she could still get a settlement and unemployment — she should see a labor attorney ASAP! Most of them will talk to you on the phone for free and/or have one meeting that won’t cost much to see if you have a case or not.

RE: “You should immediately contact the HR department and request a copy of all your performance evaluations and specific, written documentation on your dismissal. Often, that kind of request alone can put the fear of God into a company re wrongful termination lawsuits and you may have a job back- that, or a nice severance package.”

*********

Agree — Lisa should get copies of her “file” — what she is really looking for here is a settlement agreement with severance. Most likely she and the company would agree it best that she not return to that office. But the severance and unemployment would be really good and she deserves that.

Are you saying that you took a lot of calls from people complaining about the Obama channel and you had to tell people there was nothing you could do about it? Can people not block that channel if they want to? I think you could make a case for hostile working environment, for sure!

Dear Lisa,

Everyone has an opinion on what you should or shouldn't do or have done. But they were not walking in your shoes.

You made the decision you thought was right at the time. Don't second guess yourself.

If you are up to the rigor of fighting it legally, fine. Otherwise, shake the dust off your shoes and don't look back.

Peace.
