McDonnell rules Viginia must count military overseas votes

Virginia Attorney General Robert F. McDonnell on Monday said federal absentee ballots from military voters overseas must be counted, following a local registrar's decision to set some ballots aside in an attempt to follow state law.

In a seven-page advisory opinion delivered to the state Board of Elections, Mr. McDonnell said Virginia law requires overseas military voters submitting a Federal Post Card Application and Federal Write-In Absentee Ballot (FWAB) to include the name and address of a witness on the application envelope.

But he said federal law pre-empts the state provision requiring that certain absentee ballots include the witness's printed name and address. He said state registrars must count ballots that do not have the information.

"Finally, it is my opinion that general registrars may not reject a [FWAB] submitted by overseas military voters for the Nov. 4 federal election, that does not include a printed name and address for the person who signs the witness statement, unless the voter is unable to sign the application due to a physical disability or inability to read or write," wrote Mr. McDonnell, a Republican.

The opinion follows a decision by Fairfax County General Registrar Rokey W. Suleman II to set aside a number of federal write-in ballots that did not contain a witness address because of the provision in Virginia law.

The move drew criticism from Virginia Republicans, who said Mr. Suleman was taking away the right to vote from military members.

"We're following the letter of Virginia law," Mr. Suleman told the Associated Press last week.

I thought they were thrown into the trash. How will they count them now that they have been shredded into confetti and burned...and the ashes are probably buried somewhere.

Notice the term is used “follows” rather than “overturns” or “rejects” or “reverses” throughout the article.

My guess is that, like Brunner in Ohio, this cretin will defy the AG’s office.

And since when have any RATS given a rats ass about “following the letter of the law.” They are the ones who routinely peddle the idea of a living Constitution and body of law, except when it serves their political interests.

Bob McDonnell is our Attorney General, and if the state GOP doesn't blow it again next year will be our next governor.

It’s against the law to dispose of any ballots prior to the election results being certified and even then I think there is also a period of time to allow for challenges of the certified count.

Like to translate that name for you, just in case you looked it up and found it to be "English" in origin.

"Rokey W. Suleman II" has, interestingly enough, an Arabic first name, "Rokey", which is a diminutive form of "Rashid" or "Rashiddi". I can only guess at the "W" in his middle name, possibly it's "Walid" or "Wa'hab".

Yup, folks, this puke of a human bean is an Islamofascist only recently appointed to his position in Fairfax County.

Guess Alqaida wasn't able to get all their ground support forces out of the county after all.d

And yeah, his last name is also Arabic.

This guy is living down to the worst reputation of so many Palestinians isn't he.

Nothing creepy about it ~ not at all. After looking up his picture on the internet I find I recognize him as a regular visitor here.

No doubt he was up to no good hanging around this neighborhood.

BTW, it's DEMOCRATS who are "creepy", never REPUBLICANS. Until you learn that you are going to continue to have serious syntax problems and people will subject you to the most severe criticism.

BTW, Mr. Slimeball, the registrar, is a newcomer around here. But, he's readily found in the County Government Center. As Tom Davis pointed out to me years ago the big problem they have with that place is a couple of gunmen with sufficient ammunition could use the upstairs Mezzanine (that's an Arab word) to hold the county government hostage for an extended period of time. Now they've got someone with an AlQaida/Palestinian/Islamofascist attitude who actually has an office in that building.

It's just a matter of time and they'll all have problems with that puke. Time to push him out of Fairfax County government if nothing else.
