Obama and the Law (Sowell on Obama)

One of the biggest and most long-lasting "change" to expect if Barack Obama becomes President of the United States is in the kinds of federal judges he appoints. These include Supreme Court justices, as well as other federal justices all across the country, all of whom will have lifetime tenure.

Senator Obama has stated very clearly what kinds of Supreme Court justices he wants— those with "the empathy to understand what it's like to be poor, or African-American, or gay, or disabled, or old."

Like so many things that Obama says, it may sound nice if you don't stop and think— and chilling if you do stop and think. Do we really want judges who decide cases based on who you are, rather than on the facts and the law?

If the case involves a white man versus a black woman, should the judge decide that case differently than if both litigants are of the same race or sex?

The kind of criteria that Barack Obama promotes could have gotten three young men at Duke University sent to prison for a crime that neither they nor anybody else committed.

Didn't we spend decades in America, and centuries in Western civilization, trying to get away from the idea that who you are determines what your legal rights are?

In Obama's world view - the answer is yes. Some are more equal than others... Would not want to be a Jewish straight man up against a Muslim black woman who's gay. Obama's court system would be divorced from justice.

Talk about “crawling through broken glass” to vote for someone — if Sowell had entered the political arena instead of the think tank all those years ago he could have been the next Reagan. Instead we got Newt and some other DNFs.

Judges are the ONLY reason I will probably vote for McCain. The Libertarian Party still looks attractive, only because the Republican Party has abandoned me and my Constitution.

My greatest fear is not the makeup of the Supreme Court - we have four relatively young justices who are reliable in their logic and support an explicit interpretation of the Constitution plus one wimp, like some politicians, who goes both ways.

My big fear is what will happen with the justices one and two levels down. There are a lot more of those than the 9 on the USSC and they form the pool a President normally looks to when choosing a new candidate for the USSC.

Additionally, there are many Federal courts trying many cases. Only a small fraction of those cases get picked up by the USSC which is to say that many/most of these Federal Justices are “the law West/East of the Pecos!” Just look at the 9th Circus out in San Fransissysko.

Exactly...Bush has appointed 57 and Clinton 59 in the Circuits but each only appointed 2 Supremes. BO could possibly appoint that many in four years with a filibuster proof Senate.

The tragedy is that the politicians of the Republican Party didn't select him for their VP candidate. Ideally, that Reagan might have done it - tho to give Reagan slack, Sowell really made his name with Knowledge and Decisions, and that book came out right before Reagan won the nomination. But any Republican POTUS nominee since Reagan should have nominated Sowell for VP. By now, tho, Sowell is too old - would tell you so himself.

The framers of the Constitution tried to create a system which could select wise leadership such as Professor Sowell, but it has been corrupted into almost a popular vote system. For example, in 2000 the FL legislature should by all rights simply have named their electors directly, as the Constitution explicitly directs, instead of allowing the issue to fester in court. That would have been controversial, of course - but it should have been seen as the legislature's duty nonetheless. The alternative was for the courts to arrogate the legislature's authority, as we saw.

I understand that. But IMHO he is far too much of a patriot to have refused a VP nomination if a nominee for POTUS had told him he was needed.
