— discusses not the pros and cons of redistribution of wealth, but rather how to accomplish it.
— speaks of “economic justice”
— complains that the Warren Court “didn’t break free from the essential constraints that were placed by the Founding Fathers into the constitution”
— says Supreme Court so far has held that the Constitution “says what the states can’t do to you, says what the federal government can’t do to you but it doesn’t say what the federal government or the state government must do on your behalf. “
— “One of the tragedies of the civil rights movement was because the civil rights movement became so court-focused, there was a tendency to lose track of the political and community organizing and activiites on the ground that are able to put together the actual coalitions of power through which you bring about redistributive change. In some ways, we still suffer from that.”
— Caller asks if the court is the place for “reparative economic work” or if it should be done through legislation. Obama says he’s not optimistic about getting redistribution done through the courts because they aren’t structured that way (but give him a chance to appoint a few Justices . . . )
“Although you can craft theoretical justifications for it legally, you know, any three of us sitting here could come up with a rationale for bringing about economic change through the courts.”

No, I think he’s saying you won’t get sharing the wealth thru the courts but rather need to do it thru legislative and administrative means.
This audio is even beyond his wealth distribution exposed by Joe the plumber. That was generic, class orientated redistribution with Joe.
This audio is race specific, it was in the context of racial discrimination being addressed by the courts and the subsequent lack of wealth redistribution being part of the courts decision.
He has jumped the shark, he’s talking about reparations thru carefully crafted set of laws, taxes etc., that he will have the power to enact during his administration.

Seems he wants to do in a more major way what essentially exists today through the principles of a progressive tax system. Thank you Civil War: The first federal statutes imposing the legal obligation to pay a federal income tax were adopted by Congress in 1861 and 1862 to pay for the Civil War. The 1862 law levied a 3% tax on incomes above $800, rising to 5% for incomes above $10,000.
