A federal judge in Philadelphia last night threw out a complaint by a Montgomery County lawyer who claimed that Democratic presidential candidate Barack Obama was not qualified to be president and that his name should be removed from the Nov. 4 ballot.

In a 34-page memorandum and opinion, the judge said Berg's allegations of harm were "too vague and too attenuated" to confer standing on him or any other voters.
Surrick ruled that Berg's attempts to use certain laws to gain standing to pursue his claim that Obama was not a natural-born citizen were "frivolous and not worthy of discussion."

How come I suspect that we’re dealing with a CLINTON-APPOINTED judge here?
This judge knows that if he shuts down Obama’s campaign at this point in the game, he’s going to wind up like a lot of former Klinton operatives: in a lonely country road ditch, dead in a one-car “accident”. They’re not above putting a bag of cocaine in the jockey box and some kiddie porn in the trunk to really screw his legacy. I’m scared to imagine what the psycho pro-Obamans are capable of.
Here’s my own pet theory.
o O’s biological father was indeed Frank Marshall Davis.
o However, a man—a black man and a prominent communist—who impregnated a 17 year old—a white 17 year old no less—within the borders of the US would have risked prison as a statutory rapist. I have no doubt that the authorities of the day would have relished the opportunity to put Davis away for what would have been regarded as a scandalous combination of statutory rape and miscegenation. This was 1961.
o Somehow, then, BO Sr. was brought into the picture, perhaps specifically to present a Kenyan staging for the conception and/or birth.
o BO Sr. stuck around long enough to get whatever quid pro quo and to confer his name upon infant BO Jr. Whether the bun popped out of the oven in Kenya or Hawaii remains in question. A birth in Kenya actually makes sense, since it would have further forestalled prosecutory interest in the impregnation of a 17-year-old.
o Davis, as we know, returned as a father figure in O’s life thanks to the efforts of Dunham’s parents. Why?
The conjunction of BO Sr., Dunham’s parents and Davis would seem to be the Rosetta Stone of The Messiah’s ancestry.

The judge says the lawsuit is “frivolous and not worthy of discussion.” It sounds like the judge’s decision was written for him by Obama’s lawyers.

This ‘judge’ is wrong.
He saying I have no right to ‘Police’ the constitution.
However, since it is MY constitution I have every right to police it!
In fact ‘the people’ have a duty to police it — unless they wish to lose it!
His statement implies that it takes some ‘judicial power’(like him) to confer my constitutional rights — it doesn’t!
The Judge can say he hasn’t the authority, under law, to enforce Berg’s claim (as it is written) but don’t tell me or Berg or any other American citizen that they have no standing to ‘police’ the constitution.
... And considering the fact that elected and unelected ‘officials’, such as judges, can become corrupt (being human)I would like to know exactly who — if not ‘the people’ — would ‘police’ the constitution, under such extraordinary circumstances?
Maybe those of us who still believe that the constitution belongs to the people need to remove from power those that are trying so hard to take it out of our hands.
Obama is not just an ordinary citizen, he is also a united states senator.
Obama is an elected official — and a PROFESSOR OF LAW — who should be held to an even greater standard than an ordinary citizen, yet he plays legal games with the court and thumbs his nose at the very people who have voted for him... deceiving them, by posting a fake COLB on a website.
The judge is saying no one has been damaged — yet.
I can understand this as a point of law.
But the judge goes beyond the above saying it is ‘frivolous’ and ‘unworthy of discussion’.
How is a legitimate concern for our constitution — brought about by the actions of an elected official (Obama) — ‘frivolous’ and ‘unworthy of discussion’?
There is circumstantial evidence that Obama is attempting to circumvent the constitution yet concerned citizens are told by this judge that their concerns are ‘frivolous’ and ‘unworthy of discussion’.
I think not!

Do you believe this Judge is really ‘in the tank’ for obama, and, if so, what would be sufficient evidence to file a complaint against the judge?

Frankly I agree with you and sadly I really don’t think anyone cares people so much want a change and I hate to sound doom and gloom but Obama is gonna give them that change and they will wake up like the Stepford wives and husbands. Why is it Sarah Palin and Joe the Plumber being attacked by the wolves but yet something as simply as a Birth Certificate that could clear this up is not produced. I couple of years ago my HR dept sent me a letter saying I had to prove I was legally here and had to provide them with my Birth Certificate of course I did laughing I already worked for the company for 10 years and had retired from a company with 25 years is asking me who was actually born in the US to provide proof. yet the man who is running for the highest job in the land could simply end this speculation and show it. Than he could go out and laugh at all us right wing crazy people who think he has something to hide none of this makes sense. So I will go to stock up on my wine the day before election so I can lock my doors and not come out until the weekend I plan to take many days off. Where are the 527’s, how about an October Surprise no I dont believe the polls but I am getting alittle sad right now oh well can look to the next election in 2010 or 2012 if we will be allowed to vote by then.

Texasdarlin now reporting Berg says will appeal to SCOTUS.
