The Pennsylvania Democrat who has sued Sen. Barack Obama demanding he prove his American citizenship – and therefore qualification to run for president – has confirmed he has a recording of a telephone call from the senator's paternal grandmother confirming his birth in Kenya.
The issue of Obama's birthplace, which he states is Honolulu in 1961, has been raised enough times that his campaign website has posted an image purporting to be of his "Certification of Live Birth" from Hawaii.
But Philip J. Berg, a former deputy attorney general for Pennsylvania, told the Michael Savage talk radio program tonight that the document is forged and that he has a tape recording he will soon release.
"This has been a real sham he's pulled off for the last 20 months," Berg told Savage. "I'll release it [the tape] in a day or two, affidavits from her talking to a certain person. I heard the tape. She was speaking [to someone] here in the United States."
He said the telephone call was from Obama's paternal grandmother affirming she "was in the delivery room in Kenya when he was born Aug. 4, 1961."

Obama campaign officials acknowledged the dispute by posting the image purporting to be a copy of his certification of live birth earlier this year. But they've declined to return WND requests for comment...
WND reported earlier this week Berg's claim that Obama has legally "admitted" the accusations included in his lawsuit, including that he was born in Mombosa, Kenya, by not responding to the allegations.
Berg has cited Rule 36 of the Federal Rules of Civil Procedure, which states that unless the accused party provides written answer or objection to charges within 30 days, the accused legally admits the matter.

I guess we’ll see if this turns out to be another one of those Big Foot scams like we had a few weeks ago, but the thing that bothers me is how little the DNC has produced to refute these claims.
I mean, if you have solid proof he’s qualified as a citizen under the definitions of the Constitution, just disclose it and move on. But they’ve not made a lot of effort trying to do this.
This really attacks the integrity and their commitment to the Constitution, in my opinion—if they’re hiding something. And if they are and it comes out, a lot of these thugs need to go to jail for a long, long time. And if they piss on that proviso, imagine what else will be flushed down the tubes.

Yes, it’s true that children can become US citizens thru parentage, but they’re still not a “natural born citizen” as the Constitution requires. Pesky little paper, that silly Constitution.
Assuming Barry was born in Honolulu on April whatever 1961, would not that happy event be found in newspaper archives under birth announcements?

If this is the case, then the U.S. State Department must have a record of a Consular Report and Passport having been issued.
Has anyone sought these records at the U.S. State Department?
We have three children born in foreign countries (China, Russia, Philippines). The procedure was the same, EXACTLY, in each case. We were required to take our U.S. passports to the Embassy or Consulate WITH THE CHILD (!!!) along with some document from the hospital where the child was born, or with a local registration of birth.
Our son born in China was born in a Womens & Maternity Hospital that issues NO birth record, but we had the receipt of payment for services. We used a simple typewriter and produced a BILINGUAL birth certificate modeled after my California birth certificate. The attending physician signed it, and went with us to a government attorney, who produced a sealed registration, and at the same time registered our American son's Chinese name in their public records.
We took those documents and photos with the baby to the U.S. Embassy in Beijing. The Embassy staff said that they were required to see the baby to be sure that there was no attempt to smuggle a Chinese baby out of China. We have no idea what would happen in the case of a Chinese-American couple going through the same procedure, since their baby would obviously appear to be Chinese, but . . . we know what we were told at the time.
The U.S. Embassy issued BOTH a Consular Report of Birth (A U.S. State Separtment document) AND a U.S. Passport.
One daughter was born in a hospital in Vladivostok. We took that hospital's report to the public registrar in Ussurriysk City and obtained a Russian birth certificate. We took all of those documents and photos, and our passports to the U.S. Consulate General in Vladivostok, where we were issued BOTH a Consular Report of Birth AND a U.S. Passport for the baby.
Our last daughter was born at home in Batangas Province, Philippines. Our physician friend attended. We obtained birth registry applications from the local registrar, and these were completed by the physician. AGAIN we took all of those documents, photos, our passports and baby to the U.S. Embassy (Manila), and were issued BOTH a Consular Report of Birth AND a U.S. Passport for the baby.
Now, do you see the pattern?
If Obama was born in Kenya, was he removed from Kenya without a Consular Report of Birth and without a U.S. Passport? If so, WHY?
On the other hand, was Obama issued a Consular Report of Birth and a U.S. Passport? If so, then the U.S. State Department has a record, and could settle the issue on short order.
If Obama was born in Kenya, then how did his parents remove the baby from the country without a passport? How did they get the baby in to the United States without a passport of some kind?
Was Obama issued a Kenyan passport, and did his parents bring him in to the USA on a Kenyan passport?
If Berg actually has such an item, he needs to release it NOW - not "in the next few days." Early voting is already underway in several states. Absentee ballots are being filed. Every single day counts.
And if this doesn't pan out either, then shame on him for making false claims.
At this point, he needs to produce or shut up. No in-betweens.

The trouble with comments like yours is that you don’t have all the facts about Obama’s situation, apparently, and haven’t given us all the facts of your own situation either.
Of course, a child born overseas to a US Citizen can now and could in 1961 derive natural citizenship from the parents, but only when certain statutory conditions are met, which have changed over the years.
In your case, apparently the circumstances were appropriate for citizenship to flow naturally to your children in accordance with the law.
Unfortunately that leaves us nowhere with respect to either the circumstances of Obama’s alleged birth in Kenya, or with respect to the law as it existed at that time.
The fact is that under United States law in effect in 1961, a US citizen parent had to have been a US resident for 10 years, five of which are after the age of 14, in order to citizenship to derive naturally to a child born overseas if the other parent was not a US citizen. Got that?
Since Obama was the child of only ONE US citizen parent, she would have had to have resided continually in the United States for 5 years after the age of 14. Ann Dunham was only 18 when she gave birth, and there fore could not possibly met the legal conditions to permit citizenship to flow naturally to her son.
End of story. Now it is only a matter of determining as a provable fact exactly where Obama was born. There are certainly records proving this. All Philip Berg is asking is that these records be produced.
Did you hear him, however, say that NO that would not be the end of it.
Depending on the facts, he would continue the search for information on adoption and Indonesian citizenship, passport use etc.?
He is not going to quit at a VALID Hawaiian Birth Certificate. There are more conditions to a natural born citizenship, he believes, in this case.
You know at this point I think Obama could commit homicide in Times Square at high noon and the media would find a way to spin it for him and against John McCain.
BTW when you google his name on the right side of google you get the fight the smears website and click on it you get the fake Obama birth certificate, so he is standing by that debunked certificate.
