It does sound like API redux. I don't think a tape recording is going to prove anything, you will need a paper document signed and sealed by some official authority in Kenya. And, that probably won't do it without affidavits from witnesses.

If the Berg dude really had something that confirms his charge he would have laid it out on the table on the opening of the case.

The delays smell of dragging it out to gain notice and distract from real issues then have it punked just before the election to deflate opposition to BHO.
