What is the deal with Obama's birth certificate and citizenship status?

Pamela Gellers at Atlas Shrugs raises some apparent shenanigans with the birth certificate the Obama campaign previously produced. Meanwhile, Philip J. Berg, a former Deputy AG of Pennsylvania and a professed Hillary supporter, filed a lawsuit claiming Obama is not constitutionally eligible to be president; instead of simply clearing up any questions — which you would think would take about five minutes — Obama's lawyers moved to dismiss the suit and failed to file a timely answer, meaning that, under the applicable rules (according to Berg), Obama is legally deemed to have admitted Berg's allegations that he is constitutionally ineligible to be president.

Admittedly, I've ignored this issue up until now on the theory that if there was anything here worth looking at, surely the Hillary and McCain campaigns would have raised it. But this all seems very strange. It's not just a matter of whether Obama was born in Hawaii — Berg claims he wasn't, but most others seem to agree he was (though the publicly available proof seems shaky at this point). There is also the question whether he was also a citizen of one or more other countries (Kenya? Indonesia?) and whether that means, as a matter of law, that he could not be a "natural born" citizen as required by the Constitution.

Has anyone around here looked into this? Is it a serious issue, and why does Obama seem to be so squirmy about it?

Hmmm. Can 0bama still win if he is taken off of the ballot in Hawaii, Washington, California, Florida, Georgia. Pennsylvania, New York and Connecticut, I wonder. If he is taken off of the ballot in even one of these states, people would prolly vote for McCain to avoid a crisis, (or a Biden presidency, but I repeat myself).

I have a question. If Obama produces a ‘legit’ birth certificate and posts it on the internet does that not make it public property and therefore can be verified by looking at the State of Hawaii records for authenticity? He will have to post a copy not the original. The original would remain on file. Could that not be verified by someone actually looking at it?

I read that the FEC stated the allegations are “patently false.” I wonder what they based that on.

IMO, an accurate take. I blew this off at first, believeing, like most, that this has already been vetted a gazillion times over. Obama's refusal does seem to fit into the silent dog scenario.

As a sidebar, artcles elsewhere wonder/predict riots if Obama loses (or wins, for that matter). Just imagine the frenzy that would erupt if he was knocked out BEFORE the election? I half suspect that if a disqualification did pop up, the Powers That Be would hush it up just for that reason and wait for it to be sorted out if Obama wins.

The FEC is named in the suit. Berg says they have the responsibility of making sure the election is run properly and they need to do that.

The courts keep saying that an average Joe Citizen doesn’t have standing to file suit - IOW, “It’s none of your darned business.”

That’s why Berg also names the DNC. Having contributed to the DNC, his money is wasted if the DNC doesn’t do their job of nominating an eligible democratic candidate that he can vote for.

I called my Sec of State here in Nebraska and asked who is supposed to verify the eligibility of the people who are put on the ballot. The gal said the candidate makes a sworn statement that they are eligible. She was going to have somebody with more info call me back but hasn’t yet. The way to force him to release the certificate would be to charge him with perjury for filing a false sworn statement of eligibility. Then he’d have to prove he’s eligible, I’d think.

But then again, this is America. Why should we think the system will work how it’s supposed to?

They filed a motion to dismiss, which means that they don't have to answer. According to Berg, they also failed to respond in a timely fashion to his discovery requests, including a set of requests for admissions. I think, as part of their motion to dismiss, they requested that the judge allow them not to respond to the discovery until he ruled on the motion to dismiss. Good practice would be to get the judge's permission not to respond to the discovery before the discovery is due. Whether that will lead to the issues being "deemed admitted" is possible, but unlikely. More likely, they would have to respond, but have waived any objections to the requests. Only a complete failure to respond, after being ordered by the court, will usually give rise to "deemed admission".

Glad to see that more people are paying attention. I must admit I though this was a waste of time, and I think it still might be, but at the same time, there is something that he is trying to hide. It may be embarassing info on his birth certificate, but there is something. He should at least have to provide a birth certificate, a real one.
