What is the deal with Obama's birth certificate and citizenship status?
Pamela Gellers at Atlas Shrugs raises some apparent shenanigans with the birth certificate the Obama campaign previously produced. Meanwhile, Philip J. Berg, a former Deputy AG of Pennsylvania and a professed Hillary supporter, filed a lawsuit claiming Obama is not constitutionally eligible to be president; instead of simply clearing up any questions — which you would think would take about five minutes — Obama's lawyers moved to dismiss the suit and failed to file a timely answer, meaning that, under the applicable rules (according to Berg), Obama is legally deemed to have admitted Berg's allegations that he is constitutionally ineligible to be president.
Admittedly, I've ignored this issue up until now on the theory that if there was anything here worth looking at, surely the Hillary and McCain campaigns would have raised it. But this all seems very strange. It's not just a matter of whether Obama was born in Hawaii — Berg claims he wasn't, but most others seem to agree he was (though the publicly available proof seems shaky at this point). There is also the question whether he was also a citizen of one or more other countries (Kenya? Indonesia?) and whether that means, as a matter of law, that he could not be a "natural born" citizen as required by the Constitution.
Has anyone around here looked into this? Is it a serious issue, and why does Obama seem to be so squirmy about it?
Obama has already provided the MSM with a myriad of gaffes, as well as serious criminal associations, none of which they’ve capitalized on so far. Most of them are owned by the same element which owns Obama, and good jobs are hard to find these days.
They could just show it t the judge and have him agree it’s not for publication. Why doesn’t Obama do that?

You’re right that sometimes discovery can be relevant to standing, but I don’t see this being applicable here. If a citizen doesn’t have standing because the Constitution provides the one and only process for challenging a President-elect’s qualification for office is through the Congress, not the courts, no amount of discovery can “fix” that kind of lack of standing.
That said, I’ve been thinking about how to possibly style the claim to avoid the standing problem. Just kicking around ideas-—maybe the plaintiff could assert that, while the Congress is where objections to a President-elect’s qualifications must be submitted and decided, a citizen who is concerned about this issue has no way to obtain facts except through a court order to produce the birth certificate.
IOW, the plaintiff would not argue that he had standing to challenge the candidate’s qualifications or any of that other stuff about the harm being a busted election, etc.
He would argue that, since he has no other way to obtain the information he thinks is necessary to support requesting a Senator or Representative to object to the PE’s qualifications, he has standing to request production of the BC.
Something along those lines. Of course, the plaintiff would have to show some likelihood that there is relevant evidence-—i.e., that he is not engaging in a mere fishing expedition.
Another good idea. They could have a closed session in chambers and the judge could review the BC. But one would have to wonder why Obama would go so far as to do that rather than just release it publicly?

Many have claimed from a lot of posts and sites I’ve read that Berg has covered all of his bases with this case thereby giving the judge plenty of options to find standing if it’s at all possible. I’ve said from the beginning that it’s not the case so much but the attention to it and the fact that Obama and the DNC are stonewalling that’s more important since it goes to his character. What’s he hiding and why? I’m really glad to see the conservative media finally hitting this since it could help to sway independents and undecideds.

No, Phil Berg is a Democrat operative, and in my worst fear, an inside part of the plot.

It would make Republicans look foolish for jumping on the bandwagon, if O’s citizenship was provable. Further, it would take the debate off of winning issues like Joe the Plumber and Bill Ayers, and run out the clock talking about an issue which, in my worst fear, is nullified at the last moment.

If a judge rules he’s not a NATURAL BORN citizen there’s no way they can hide it. If they try, there’s a good chance there will be CONFLICT. I don’t want to use the W-word.
