As of last week, gay marriage opponents had raised more than $19.7m, compared with $18.5m raised by gay marriage supporters, according to data compiled by the Los Angeles Times. If the Yes on 8 runs twice as many ads as the other side for only 6% more money, that's efficient use of the money.
I've heard the Gavin Newsom "whether you like it or not" ads every day, and I've seen some TV ads supporting Prop 8. They are all very good.

That was a statute. A constitutional provision cannot be overruled by a state high court. They are obligated to uphold it and its binding on the executive and legislative branches of the government.
