Branchflower Report Released: Palin was within her rights to fire Monegan

The headline that will be screamed from the rooftops everywhere is Branchflower's claim that Palin "abused her power."

But he also admits she was within her right to can Monegan.

I've skimmed through much of it and the basic conclusion is that Todd Palin was trying to exert pressure to get Wooten fired, and Palin should have stopped him from doing this. She herself is not accused of doing anything.

Pretty thin gruel.

But of course, the media will have an orgy with this.

This is what she is accused of violating.

It doesn’t matter that what she did was in the end lawful. The first and foremost accusation is that she violated ethics.

Again I’m pointing out the obvious here.

Well impeachment would have to start in the AK House just like in the US govt. This is just a committee and they have no power to impeach. Wonder where her legislative appointed attorney is here?

Article 05. ENFORCEMENT; REMEDIES
Sec. 39.52.410. Violations; penalties for misconduct.
(a) If the personnel board determines that a public employee has violated this chapter, it
(1) shall order the employee to stop engaging in any official action related to the
violation;
(2) may order divestiture, establishment of a blind trust, restitution, or forfeiture; and
(3) may recommend that the employee’s agency take disciplinary action, including
dismissal.
(b) If the personnel board determines that a nonsalaried member of a board or
commission has violated this chapter, it (1) shall order the member to refrain from voting,
deliberating, or participating in the matter; (2) may order restitution; and (3) may recommend to
the appropriate appointing authority that the member be removed from the board or commission.
A violation of this chapter is grounds for removal of a board or commission member for cause.
If the personnel board recommends that a board or commission member be removed from office,
the appointing authority shall immediately act to remove the member from office.
(c) If the personnel board determines that a former public officer has violated this
chapter, it shall
(1) issue a public statement of its findings, conclusions, and recommendation; and
(2) request the attorney general to exercise all legal and equitable remedies available to
the state to seek whatever relief is appropriate.
(d) If the personnel board finds a violation of this chapter by a public officer removable
from office only by impeachment, it shall file a report with the president of the Senate, with its
finding. The report must contain a statement of the facts alleged to constitute the violation.
Sec. 39.52.420. Disciplinary action for violation.
(a) In addition to any other cause an agency may have to discipline a public employee, an
agency may reprimand, demote, suspend, discharge, or otherwise subject an employee to agency
disciplinary action commensurate with the violations of this chapter. This section does not
prohibit the review of a disciplinary action in the manner prescribed by an applicable collective
bargaining agreement or personnel statute or rule.

The political members of this panel that produced this hoax are the ones that should be impeached. Where is her attorney? He should be screaming about this, exposing the partisan members of this panel. Why don’t Republicans have any fight?

Again I don’t thinkl that matters.

However for those looking for a beam of light here....what I’m reading...and yes it’s a ton of stuff is that the personel board has some part in this.

As many of you know the personel board was against this as they didn’t thinkl she did anything wrong. Also I think the attorney general is on her side (correct me if you have something).

So other than a friday news dump...and the Sunday shows..it may go nowhere.

And look I read up on it called no one a troll or muslim...aren’t I special LOL

The legal opinion is that she acted within her right as Governor of Alaska to hire and fire whom she chooses. The “abuse of power” is that dems didn’t like what she did. End of story.

No the accustion is she violated ethics. I posted the ramifications of that earlier. The second statement by Branchy (my new nickname) does not negate the first.

Violation of ethics is pretty covered by the Alaskan Govt. That’s why he threw it in there.

Ethics? PUHlease...she offered him another position within the govenrment equal to his job, he refused. He left the government willingly at that point. The dems don’t like it. So what? Sarah chose to govern, hope she does the same in Washington.

Look I’m just pointing out whats in the documents and what those accusations mean. Will she get impeached...most likely not.

Is an attempt at impeachment going to be tried...sure. If I were running the Democratic side I’d go for it.

Again, personally I always thought Palin was a bad pick because of this whole mess.

However we can hope for a quick death on this.

And....you signed up Sept 2 2008 ....yeah.

Other than personal attacks, do you have anything to add. Dem strategy on this one. How it may or may not affect independant voters. What the ethical charge actually means as part of the bigger picture.

Throwing out insults really doesn’t add.

Maybe it’s me or is FR just going down. I used to love posting here but have hesitated for months because of crap like this.
