Ohio Secretary of State Jennifer Brunner is breaking federal law by not giving county elections boards the chance to determine whether new voter registrations are fraudulent, a federal judge ruled tonight.
It is hard to imagine a public interest more compelling than safeguarding the legitimacy of the election of the president of the United States, said Judge George C. Smith of U.S. District Court in Columbus, in upholding the Ohio Republican Partys request for a court order.
Smith, appointed by President Reagan, said the Help America Vote Act requires states not only to verify the identity of newly registered voters with the state Bureau of Motor Vehicles and the federal Social Security Administration, but to provide counties with the names of new voters whose records did not match.
Brunners office had been doing the verification but had not made the names available to county elections boards. The judge gave her a week to comply.

He specifically cited questionable activity of one group that registered thousands of new Ohio voters: the Association of Community Organizations for Reform Now, or ACORN. Ohio Republican Party Deputy Chairman Kevin DeWine said the ruling spoke volumes about Brunner, a Democrat.
Her refusal to comply with federal law raises serious concerns about her ability to objectively oversee this election. It's especially troubling in light of her connection to ACORN and that group's stunning confession this week of fraudulent registration activity happening right here in Ohio, he said.

Sounds like ACORN news is starting to get its legs out in the everyday world...
Recall or impeachment available?
Thank you Judge George C. Smith. You are a true patriot.
Most reasoned judgement I’ve heard from a judge in a loooong time.
So does this apply to the same date register and vote activity from last week?
Would love to see it.
Well glory be! It’s about time!!! I wondered if her decision would be contested.
Brunner knew what she was doing all along. She has been playing games with the election process for the last 2 years.
CEOs of corporations need to personally certify the annual financial reports of their companies. Failure to be honest is now punishable by law. I believe that each Sec'y of State, or other official that certifies an election, should be held to the same standard.
Recall no, and impeachment unlikely.
Just vote out the partisan hack in 2010
Remember what Chicago did in 1960. Now we have Obama from Chicago. I believe the next election will be outright stolen.
Recall probably. I don’t recall if the Ohio Congress still is in GOP hands or not.
A WEEK TO COMPLY??????????????
We won’t seat a new President until Mid Year!!!!
her connection to ACORN???????
IOW - (my words) "I doubt that you are qualified to do your job and your ties to ACORN buttress that doubt. Perhaps someone else should do your job. Maybe I should place this federal election in Ohio under the purview of the Federal Courts and temporarily appoint a master who will perform the constitutional oversight required for such an important event."
Wow, after a very depressing afternoon on here, I take my kids to go see Beverly Hills Chihuaha..(needed a little escapism) and when I get back there is all sorts of News threads that could be good news for McCain! (The Drudge Headling of a breaking story on Iraq/Obama, CNN reporting on the Obama/Ayers connection, ACORN heating up in the news, and finally someone has sense in Ohio!
I’ll sleep better tonight at least.
ACORN is receiving tax money at your expense. :D
Have a nice day. :D
“Ohio Secretary of State Jennifer Brunner is breaking federal law”
This person needs some serious jail time. The sanctity of vote separates us from chaos. It is not to be trivialized.
Glad someone is looking at this. I think this is what twerpy little liberals on college campuses are hoping/promoting happens with their Obamatard Army.
