Phil J. Berg filed an amended complaint today in Berg v. Obama. The amended complaint adds the Pennsylvania Department of State, the Secretary of the Commonwealth Pedro A. Cortes (in his official capacity), the U. S. Sentate Committee on Rules and Administration, and Senator Diane Feinstein (in her official capacity as chairman) for their failure to exercise due diligence with respect to Barack Obama's contitutional qualifications to be elected and serve as President of The United States, and for his inclusion on the ballot in Pennsylvania as a candidate for President of the United States.
The amended complaint also bolsters the standing argument and adds additional relevent facts.
Essentially, the argument is this:
* Senator Obama could put this whole issue to rest by providing an official "vault copy" birth certificate. * Senator Obama has chosen not to do so. * The defendants (other than Obama) have a responsibility to protect the integrity of the electoral system by properly vetting the qualifications of candidates, which they have failed to perform. * Mr. Berg, other Americans, and our system of government are damaged by this failure. * Senator Obama, who has collected $425,000,000 in campaign contributions, has perpetrated a fraud.
Following are some of the factual statements made in the amended complaint (The complete complaint is attached below):
36. Obama is a representative of the Democratic People. However, Obama must meet the Qualifications specified for the United States Office of the President, which he must be a natural born citizen. Additionally, Obama must be at least a naturalized citizen to hold his Office of U.S. Senator for Illinois. Unfortunately, Obama is not a natural born citizen, nor is he a naturalized citizen. Just to name one of the problems, Obama lost U.S. citizenship when .. mother married Indonesian citizen..

I just dont know what to think. What would be the advantage of sitting on his BC if he has one? Why drag this out? Cui Bono?
***He doesn’t have one. If he had one, he’d have sprung that trap by now. However, this is as high of stakes as you can get, higher than high stakes poker. Cui Bono? Obama benefits. What he’s been doing is buying time so that a perfectly good copy of his fabricated BC will be in place when this whole thing blows over. The fix is in. Why did he have to go through with it this way? Because he’s stupid: he didn’t know the difference between a CoLB and a birth certificate until after the forgery was generated. So he had to take a whole week off in the middle of campaigning & wander over to Hawaii to make sure the fix was in.
And if he doesnt have one, doesnt he realize the mayhem and turmoil he will cast this country into by either being DQd before the election or deposed after? His narcissism is so huge he doesnt care what happens?
***Yes, this can be tagged as a narcissistic ploy. Obama doesn’t care how much damage this would cause this country — like his wife he probably hates this country anyways. Like most liberals, he has no real respect for the constitution. He feels this eensy weensy wittle issue shouldn’t be there ‘cause it aint fair anyhow. And when he gets elected, he’ll just say, ‘well, we need to change that little stupid section of the constitution’. He already tried that once, during the “sense of the senate” stuff on John McCain’s birth controversy.
Getting harder and harder around here.
I am relatively certain that the secretaries of state of the individual states are required to certify that the candidates that they place on the ballot are eligible to be there and to hold office should the candidate win. Prudence, prevailing state and federal law, and common sense would dicatate how each secretary could satisfy their obligation. Demanding state certified proof of citizenship would be included as a reasonable requirement.
You are relatively certain? So then if Obama is on the ballot in all 50 to 57 states plus the District of Columbia, then are you relatively certain that each of them certified he was eligible to be president? And then can you state with relative certainty that Obama must have been born in Hawaii and must be a natural born U.S. citizen since he's been vetted by all these secretaries of state? And since you're relatively sure they checked his birth certificate as part of their process?
Like that's going to happen.
Would you still want him to be sworn in???
Legally he could not be sworn in. So no.
This is a guy who traveled to Kenya to assist in getting Odinga, a radical terrorist MarxistLeftistCommunist elected.
Did you forget a sarcasm tag or just not read the post you replied to?
That section was repealed in 1952.
>Section 317(a) and (b) of the Nationality Act of 1940, referred to in subsecs. (a) and (c)(1), which was classified to section 717 (a) and (b) of this title, was repealed by section 403(a)(42) of act June 27, 1952. See subsecs. (a) and (c) of this section. source
This is what I responded to......The "probably" part.....
Maybe I missed something? Wouldn't be the first time....
"The Constitution sets qualifications for the president, and then the people decide who they think would be the better president".
The Clintons have been onto Obama from the beginning. He is NOT eligible.
Go, Phil, GO!
Clinton said something else like that, ‘if he’s constitutionally qualified’.
How do you see this ending? Obama produces a legit BC? Time has way run out for him to DQ himself without causing horrible problems for the DNC and their voters.
Yes he did, recently.
Funny how Bill slips that little qualifier into his answers to questions about Obama, isn't it?
Kevmo: like his wife he probably hates this country anyways.
OO: Listen...quit giving Obama a pass on his loyalty to the U.S.A. and for what it stands for.
***Saying he probably hates this country is giving him a pass on loyalty? What color is the sky on your planet?
We are on the same team.
It appeared to me, that you said Michelle most surely hated America...but you only said Obama.."probably" did.
That was my only point....
Maybe you misspoke? I dunno...and the sky here today is gray. : )
Another guy with a lawsuit against Obama is trying to merge his with Bergs:

Well, we don’t have video of Obama saying that, just a body of evidence that points in such a direction. So for now it’s ‘probably’. Of course, his pastor for 20 years really hates America. But we are expected to ignore such evidence, that a Harvard grad was ahhh... not paying attention.
The sky here is bright blue, 1 or 2 clouds, 75degreesF, 5mph winds.
He's been influenced by too many "hater's" of America, for me to not come to this conclusion. I can only gather the info that I know of...and make a determination. And I've done it.
Best FRegards,
Look- you are the one that recognizes that citizenship is a requirement, but says that nobody is allowed to ask for the documents that prove it.
Bass Ackwards.
No, statement of fact. You can ask all you want, Obama is not legally required to submit to your request. But, as I've said time and time again, all you have to do is present your evidence that Obama was NOT born in the U.S. and is NOT a natural born U.S. citizen and you can put all this to rest. But you can't.
I am hoping it will be in the form of a direct question from Johm McCain. “Mr. Obama. I challenge you right now to produce a certified legal copy of your birth certificate proving you are a Natural Born Citizen of the United States. Failure to immediately make this document available to the public will otherwise constitute a failure to prove your Natural Born Status and makes you ineligible to run for the Office of President of the United States. Mr. Obama, where were you born and where is your Certificate of Live Birth?”
It is astounding that Obama simply hasn’t produced one, I am certain that the Secretary of State in Hawaii would expidite the document immediately to Obama should he ask, less than 24 hours it would take I bet. Give that the stakes are so very high.... Golly, makes one think that there ISN’T one.
I will faint dead away if McCain mentions the BC.
It would be the most explosive moment in political history.
But someone has to, and quick.
