There were not many conspicuous tributes to the legacy of President Bush at last month's Republican National Convention, but there was at least one.
It was a campaign button with the words "Thanks, W" across the top and photos of Chief Justice John G. Roberts Jr. and Justice Samuel A. Alito Jr. beneath the letters.
Conservative legal activists view the two men as remarkable successes in Bush's quest to move the court to the right, and that is part of the reason that, as the court begins its work anew today, public attention is focused less on the cases at hand than on the court's future.
It is a future entirely dependent on whether Sen. John McCain or Sen. Barack Obama prevails in November.
"A President Obama or a President McCain will likely be handed an opportunity to affect the makeup of the Supreme Court that is unprecedented in our history," said Wendy Long, chief counsel for the Judicial Confirmation Network, which was active in generating public support for the confirmations of Roberts and Alito.

In July 2007, Obama said flatly at a Planned Barrenhood event that he would appoint only justices who have empathy for pregnent teens, gays, minoritys, the discriminated, etc. - in other words, justices who will not side with white, Christian, Republican, traditional, or conservative beliefs of ANY kind and who will legislate activism from the bench.

Supreme Court and union card check law will be the biggest domestic “legacy” of an Obammy term.
There is no doubt that Obama, if he were to win, would be given great leeway in appointing the 4 liberal justices of the court. All of those currently serving would retire to accomodate Obama’s selections. Stevens is old, Ginsberg is sick, Breyer and Souter would be encouraged to step aside for very young replacements.
This will be possible because the dems will have 55+ votes in the Senate if Obama wins, and there are a minimum of 5 Rinos.
Why give up now? Did you see McCain’s rally in Albuquerque today? He NAILED Obama on pretty much all the talking points FReepers have been pushing for. A grand slam!
We have that in NY. It's a disaster.
I am also concerned about the possibility, especially if Obama gets elected to a 2nd term, that Scalia and/or Kennedy would pass away or otherwise just call it quits.
