Exonerated Marine to sue Rep. Murtha

One of the Marines cleared in the killings of Iraqi civilians in the town of Haditha plans to sue his congressman today for statements he says defamed him and other members of his squad.

Former Marine Lance Cpl. Justin Sharratt, 24, of Canonsburg, will file a civil lawsuit against U.S. Rep. John P. Murtha, D-Johnstown, who was widely quoted two years ago saying that eight Marines carried out a cold-blooded killing of 24 civilians in the Iraqi town on Nov. 19, 2005.

Obviously, Sharratt and Geary think otherwise.

Hopefully, like even with free speech rights you still can't yell fire in a theater, you can't defame, lie and slander even though you have "privliges."

Murtha is toast as far as the suit going to trial.

The venue and jury is open to question.

I hope you're right. I'm just going from past attempts. Members of the Left are constantly trying to sue Bush and Cheney over the war, etc. Always thrown out. Paula Jones was successful because Clinton's actions were outside his official duties.

Like I said, I hope you're right.

I hope he get's a good lawyer.

(I mean a Marine, not a Scientologist, although you have to admit the Scientologists have some good lawyers.)

McDermott broke an actual law, Murtha was giving a press conference. Unless the Marine gets his legal fees donated, he will be out of money before fatso. McDermott also set up a “legal fund” and I’m sure never paid out a cent of his own.

Understood and thanks for the reply. Take a look at the link brityank posted. This is what is looked at in the legal arena. Now it's up to the ability of the attornies to put this case together and argue it in court.

I just get a blank screen, but, like I said, Murtha was holding a press conference in the Capital building, in his official capacity as a US Congressman. The Marine will have to prove Murtha knew what he was saying was a lie and said it anyway out of "malice".

We all know Murtha is a leftist dick, I'd hate to see the Marine bankrupt himself...on the other hand, if someone is picking up his legal bills, I'd say go for it! For as long as it takes.

He did some of this at Capitol presser, but most were on talk shows. These shows won’t be protected and we might get to see the fat ass EX Marine in the witness chair. I have my fingers crossed and a check on the way to Lance Cpl. Sharratt.

Before of AFTER he made those slanderous comments on “Meet the Depressed” or whichever Talking out their a** Show?

If he was introduced and billed as “Congressman John Murtha”, he’s appearing in his official capacity. This isn’t England where proving slander is much easier.

Obama: You know, I don’t have the exact quotes in front of me. What I know is here is a guy who served our country. I would never second guess John Murtha... I think he’s somebody who knows of which he speaks.
Remember, when you hear Obama agree with Murtha’s “cold blooded murder” accusations against US troops, that today this is the “moderate” voice of the Democratic Party!

And, also, please don’t forget that... Democrats support the troops!!!

As a Marine officer, he is on indefinite duty and never discharged entirely

he could still be recalled to active duty and court martialed

and he would deserve the same treatment his own words created for the men he slandered
