I think they know that Double Jeopardy would attach, so by dropping the contempt charges, they hope to remove the 5th amendment covering.

After watching the reception Nazario's jury gave Fox's mud pie, the prosecution is likley trying to get a plea deal -ANY deal that can scrub that big L off their forehead.
Fox must be real popular with his peers right about now.

The court requested and the government agreed to prosecute a contempt action... Whoa, back up the Binky Baby Bus!! Last I remember, the fumbling assistant flamethrower had strained peas shooting out of every pore as he demanded that the judge jail Weemer & Nelson immediately for contempt, without a hearing, and for the max possible!

You’re absolutely right. Though the Marine’s refusal to testify against each other make convictions highly unlikely. From the Hamdania case to this one, prosecutors have relied on Marines rolling over on each other. And even when that has happened, a conviction is still not been a sure thing.
I’m optimistic that both cases will be dismissed before winter. We’ll see.
