Why is what she said not illegal?

Can she be prosecuted for talk like this?

To me, this sounds like a terroristic threat and this pig should at a minimum be interviewed by the Secret Service.

If her statement was actually very close to "When Sandra warns Sarah Palin not to come into Manhattan lest she get gang-raped by some of Sandra’s big black brothers", then an argument could be made that the threatened black rapists would be acting at the instigation of Bernhard, which could result in Bernhard getting a visit from the Secret Service.
