EL PASO, Texas — Two former Border Patrol agents convicted of shooting a drug smuggler and trying to cover it up have been denied a request for a new hearing.
The 5th U.S. Circuit Court of Appeals in New Orleans denied the request by Ignacio Ramos and Jose Alonso Compean on Wednesday. The same court upheld the men's convictions in July.
No reason was given for the Wednesday's denial.
Ramos and Compean are each serving sentences of more than 10 years for shooting Osvaldo Aldrete Davila in the buttocks while he was fleeing from an abandoned marijuana load in 2005.
Aldrete was sentenced to 9 1/2 years in prison for his role in two seperate smuggling efforts later that same year.

Baloney. Compean was a well trained LEO and sharpshooter. Ramos hit the same moving target with one shot from a much greater distance. Compean wasn’t trying to hit OAD.

Ya, Compean was in fear for his life and those of his fellow agents, one of whom now sits in prison and three others who lost their jobs and careers trying to help him.

The fact that he was illegal or that the van had maryjane in it wasn't known by anyone until after the shoot.

Ramos was eating lunch at the station. He testified that he responded because it was called out as "narcotics smuggling". Kanof attempted to pillory him because the ten code supposedly meant "narcotics apprehended". That is a red herring. Ramos responded because narcotics was involved. Nearly the whole complement of the station also responded including Supervisor Richards with camera in tow. Plus Davila got shot in the ass for his actions.
