As president of the Harvard Law Review and a law professor in Chicago, Senator Barack Obama refined his legal thinking, but left a scant paper trail. His name doesn't appear on any legal scholarship.
But an unsigned — and previously unattributed — 1990 article unearthed by Politico offers a glimpse at Obama's views on abortion policy and the law during his student days, and provides a rare addition to his body of work.
The six-page summary, tucked into the third volume of the year's Harvard Law Review, considers the charged, if peripheral, question of whether fetuses should be able to file lawsuits against their mothers. Obama's answer, like most courts': No. He wrote approvingly of an Illinois Supreme Court ruling that the unborn cannot sue their mothers for negligence, and he suggested that allowing fetuses to sue would violate the mother's rights and could, perversely, cause her to take more risks with her pregnancy.
The subject matter took Obama to the treacherous political landscape of reproductive rights, and - unlike many student authors - he dived eagerly into the policy implications of the court decision. His article acknowledged a public interest in the health of the fetus, but also seemed to demonstrate his continuing commitment to abortion rights, and suggested that the government may have more important concerns than "ensuring that any particular fetus is born."

Wait just a durn minute! I thought Obama said determining when a baby has human rights was above his pay grade.
It's all they write about.
What is incredible to me is that Obama didn't write anything but an unsigned "Note" on HLR. It's my experience that the staff of any law review is expected to write at least one leading article during their tenure. Usually their output is fairly substantial.
And he never clerked for even a circuit court judge, let alone one of the Supremes.
Looks like a free ride figurehead to me.
Methinks that Obama has had the affirmative action ride that affirms the Peter Principle in a very fine way.
Unfortunately fairly typical of law school exams, although not as well written as most.
In a Constitutional Law class I suppose all the policy discussion is going to happen, but a better exam would have had at least one constitutional issue that's in dispute between the circuits (the main reason things get to the Supremes).
The more information we get about The O, the longer the list gets of “Things Out Of His Pay Grade”.

It's the zero sum mentality at work: the less people who need a piece of the pie, the bigger the slice. And the size of the pie never changes, nor the needs of the eaters.
The less babies born, the better. Obama's objectives are not any different from the policy of the Democratic party for generations: keep the minority poor beholden to you by doling out money in wasteful programs, but never actually design programs to succeed in taking them out of poverty, and thus, your constituency.
Obama adds one more layer to the power play: those employed by so-called community organizations endowed with government money and zero accountability become an army of supporters and campaign workers equally dependent on both the largesse and corruption of politicians.
