Wednesday, August 20: Jury selection is complete in the Jose Nazario trial.
Fifty-four jurors were pooled, twelve (and two alternates) were chosen. There are nine women and three men on the jury, most have military members in their family and some are veterans. Jose Nazario is happy with the jury selection and confident that justice will be served.
Opening statements are scheduled for tomorrow. And so we begin....

This is intended as a main thread for the Jose Nazario trial--which the judge (at least) hopes will wrap before Labor Day. I'm sure there'll be additional threads, but you can always check here for the latest in news and analysis. You can also check for updates

Just in—
Sgt Nelson has been offered no jail time in exchange for testimony against Nazario.
Nelson’s lawyer won’t comment, and no one knows Nelson’s intentions in light of this latest inducement from the gov’t.
More to come....

Is this "no jail time" under the UCMJ or what? Thanks for the thread!

Other than the prosecution attempting to bribe Sgt. Nelson it sounds good so far.
Girlene's question raises another one ~ suppose the military honored the dishonorable deal they offered Nelson, and Nazario was convicted in a civilian court, while the Marines dismissed charges against Nelson.
What would keep the DA from using the statements Nelson used to save his own butt in a court martial against him in a charge of murder as soon as he was discharged?
As Girlene has oft pointed out, they have opened a can of worms that should never have been opened.
These Marines' battle is far from over. The battlefield has changed, and even bears some similarities to the the United States of America, but they are still surrounded by enemies, and the only ones they can count on are each other.
I pray Sgt. Nelson recognizes that.

I don’t like this whole affair one bit regardless of how good a choice the jury may represent. This trial is going to lead to a new precedence where any of our military folks are going to stand the chance of going to jail for things they had to do during war time conditions.

I thought so too at first, but Nazario was a rifle range instructor and so he rated the cover.

Juries are always worrisome because they can only judge on the facts given to them, and are subject to following the rules the judge hands down for a particular charge. But it IS a good sign that there are many with some military background, either personally, or through their families.

Good point and good question.

Excellent advice, 4wb. All that Sgt. Nelson needs to do is to remember Fallujah. It was the same concept (albeit with more immediate and dangerous consequences).

The situation is very fluid—still lots of uncertainty. If all goes as planned, we should have a full report by three or four Eastern. Hope we’ll know more then.
BTW, Thad Coakley, the Marine lawyer, is there in civilian clothes, advising the feds.
