Republicans called for a criminal probe of Senate Minority Leader Malcolm Smith for allegedly threatening lobbyists who fail to contribute to Democratic campaigns. "It borders on criminality," said Senate Majority Leader Dean Skelos. "You cannot threaten people to give contributions. That's thuggery. Quid pro quo is a crime - you go to jail." Senate Investigations Committee Chair George Winner said Smith, of Queens, "may have broken several laws - including coercion, official misconduct, attempted bribery and even conspiracy." Smith told a group of lobbyists at a fund-raiser for Senate Democrats in that their clients would be shut out of a possibly Democrat-controlled Senate in January if they didn't pony up large contributions now. Smith refused to discuss his remarks, but late yesterday, he issued a statement claiming his remarks were meant to "entertain" the lobbyists who attended the event.

Authorities might ask whether Sen Malcolm Smith (D-Queens) fraudulently used tax-exempt bond revenue allocated to the Minority Leader's office. Authorities need to determine the extent of tax-exempt bond revenue used for illegal activities involving the Democrat Party. Tax-exempt investors may have been misled and the IRS may have also been deceived. (Stolen money is taxable.) Government computers and equipment (printers, faxes, email, and other electronic devices) may have been used in government fraud and to enrich the Democrat Party. Tax-exempt investors need to know whether tax-exempt bond revenue was used to underwrite fraudulent activities. Sen Malcolm Smith may have engaged in a conspiracy with Jeff Klein (D-Bronx), in government fraud, illegal conversions of tax-exempt bond revenue, and money laundering, to subsidize illegal activities involving the Democrat Party.
BACKSTORY Senate Minority Leader Malcolm Smith (D-Queens) allegedly said he would send Sen Jeff Klein (D-Bronx) as an "enforcer" against lobbyists who didnt donate to Democrats. Smith, the married father of two fathered an out-of-wedlock child with a woman other than his wife three years ago. Smith told lobbyists their clients would be shut out of a Democrat-controlled Senate in January if they didn't pony up large contributions now. A longtime lobbyist said, "It was a shocking set of remarks and people were looking around the room in disbelief......far more blatant a threat than anything we're used to hearing from many of the leaders." Smith also made "an inappropriate" sexual innuendo at the Senate Democratic golf outing held at the Wiltwyck Golf Club, attended by about 75 lobbyists who paid up to $75,000 each.
