Hill letter urges Bush 'review' of jailed agents' case (Duncan Hunter Alert)
Wash times ^ | 7/30/08 | Jerry Seper

Posted on 07/30/2008 8:15:10 PM PDT by pissant

Thirty-one members of Congress on Wednesday asked President Bush for an "immediate review" of the convictions of former Border Patrol agents Ignacio Ramos and Jose Compean, who were sentenced in 2006 to lengthy prison terms for shooting a drug-smuggling suspect in the buttocks as he fled back to Mexico.

"Should you be unwilling to pardon Agents Ramos and Compean, as some of us have advocated, we ask that you then consider commuting their sentences to time served," the Republican lawmakers said in a letter.

"Your intervention in this matter will not only serve to correct this injustice, but also help reverse the damage these convictions have caused to the men and women of the Border Patrol," the lawmakers said. "Once again, we respectfully request that you intervene on behalf of Agents Ramos and Compean, and remove them from federal custody."

Written by Rep. Duncan Hunter of California, the letter was signed by fellow Republican Reps. David Dreier, Dana Rohrabacher, Brian P. Bilbray, Ken Calvert, Ed Royce, John Campbell, John T. Doolittle, Howard P. "Buck" McKeon and Gary G. Miller of California; Trent Franks of Arizona; John L. Mica and C.W. Bill Young of Florida; Christopher H. Smith, Frank A. LoBiondo and H. James Saxton of New Jersey; Marsha Blackburn of Tennessee; John Carter, Ted Poe and John Culberson of Texas; Tom Tancredo and Doug Lamborn of Colorado; Phil Gingrey of Georgia; Steve King of Iowa; Walter B. Jones of North Carolina; John M. McHugh of New York; Frank R. Wolf and Virgil H. Goode Jr. of Virginia; Don Young of Alaska; Joseph R. Pitts of Pennsylvania; and Todd Akin of Missouri.

This Bonilla guy is an absolute idiot, but it makes sense that you would worship him because he is smarter than you.

But thanks for proving my point, the van was properly registered to an American citizen with US plates. So as far as Ramos and Compean knew, this guy was a US citizen.

BTW - When you sell a car, you submit an affadavit of transfer/non responsibility to the DMV so they know the car has been transferred to another party, which wasn’t done. All we have is this guys word that he “sold it to a friend in Mexico”.

Right.

But you’ll believe absolutely anything as long as it helps people who shoot Mexicans in the back. Why don’t you just admit it.

“The jury was not even allowed to see all of the evidence!!”

The jury saw all the evidence the jury needed to see. The issue of the second load had no bearing on whether Ramos and Compean shot in self defense that day, the rulling was correct by the judge and was affirmed by the appeals court.

Now if you threaten to hold your breath until you turn blue, maybe THAT will get the evidence entered into the record.

Yuppers

And the only appropriate response to him is:

I swear Andrew, sometimes I thnk you must be an eight year old smacking away at your keyboard for attention.

"The vehicle was sold to a Mexican national by an El Paso dealer."

Really? Where is the DMV paperwork on that transaction?

"Therefore the Texas plates were illegal."

Since the "dealer" never submitted the proper paperwork on the transaction to the DMV, the plates were legal at the time of the shoot.

"And for not being anything worth catching, the nearly total contingent of the Fabens station was sure interested in something about Davila and his van."

Not until the high speed chase and that gets most cops blood flowing...remember Rodney King. Anyway, it was a slow afternoon down at Fabens that day.

"Innocent people don't run from border patrol agents."

If a cop tried to split my head open with the butt of a shotgun, I might run as well.

"Plus, they wouldn't know anything for sure about Davila until they caught him."

So in the absence of catching him, shooting him in the back is just as good.

"This whole event was not made up whole cloth for you to call the border patrol agents idiots."

Unlike you who has called about a dozen other Border Patrol Agents corrupt perjurers on the take, you know, the ones who disagreed with any of the incomprehsible Ramos or Compean testimony.

"They had good cause to do what they did..."

12 jurors, a 3 judge appeals panel and the entire justice system disagrees with you.

"And Ramos had no reason to be pissed off that Davila got away."

No, that was Compeans job.

"Plus, I really doubt you have any expertise in the sound of pistol fire."

My four handguns, two rifles, two shotguns, 9mm Uzi and Galil. 223 would disagree with you.

"Agents wear ear protection when they fire their pistols and the discharges are not from 50 yards away and on the other side of a levee."

I'm sorry, are you stating LEO's know the sound of their own weapons?

"And Beretta 40 cals are not the exclusive property of the border patrol..."

Especially when they look like cellphones.

"I do not think that Ramos has X-ray vision...

No, Ramos does not have xray vision but he sure was a hell of a better shot than Compean on that day.

"But I do know that Ramos did not testify that he saw Compean on one knee reloading and shooting again."

Yes, and I believe he lied about that.

"Compean testified he never fired from the second magazine...",

Compean testified about a lot of stuff that seemed at odds with the physical laws of the universe.

"...and Juarez lied about seeing Compean shooting from the second magazine at the top of the levee and fully upright. So stop lying."

In your book everyone lied, Juarez, Vasquez, the supervisors on the scene, the border agents from El Paso, the judge, the prosecution, the witnesses, the evidence. Funny thing is the only people who you think didn't lie are cooling their heels in a federal penitentiary for a dozen years. Remind me to never take a horse race tip from you.

This Bonilla guy is an absolute idiot, but it makes sense that you would worship him because he is smarter than you.

Well, you have just given evidence of your own stupidity. You gave no evidence that the van was properly registered. You just used a portion of what I presented in an attempt to justify your lies. The fact is, the van was registered to Bonilla and he stated he sold it. If you have evidence to the contrary, produce it. Unless you live in Texas, as I do, you are walking on thin ice telling me what is required in this state. It is the responsibility of the buyer to transfer the title. The seller is only required to sign the applicable documents. The buyer has 30 days in which to transfer the title.

I am of Mexican heritage and my wife is a Mexican citizen here as a permanent resident, so your comment about shooting Mexicans in the back is both offensive and incorrect. Davila was shot because he failed to comply with the legal and reasonable commands of officials of our government, upon his demonstration of actions perceived as threatening by those officers, he was shot at.

Get a cogent thought.

Your put downs to various posters just might show you are doubting your own posts. Maybe you’re coming around.

“The jury NEVER was told that the Gov’t lead witness was a major mule who repeatedly ran dope across the border.

The jury was NEVER told that the lead witness Davilla was implicated 4 months before the trial in another dope load and this was while he was under immunity for the first dope load.

The jury was never advised that the witness Davilla broke the immunity by not fully cooperating with names and information about his employer - the cartel. In fact the US Atty told the three judges last December that their guy - Davilla - “told some lies” in his testimony. Wow - they knew he lied and they went along with it. Simply put that’s perjury by Davilla and suborning perjury by the US Atty team.”

The JURY HAD THE RIGHT to see all of the evidence!!

You have 1 1/2 hours today to call the White House at 1-202-456-1111, or call them next week.

Tonight e-mail the president at: comments@whitehouse.gov

Put what you want in the subject line in case your entire e-mail is not read.

I told the president that I would like the agents to be pardoned, but at least commute their sentence for years served, and please show the compassion on these men and their families that he would want his own loved ones to receive.

I ended my e-mail with “May God bless you and guide you with making your decision.”

Also, of course, I called as well.

And I am praying for these men and their families. They have suffered so much.

DMV paperwork is the responsibility of the buyer. http://www.window.state.tx.us/taxinfo/taxforms/14-312.pdf, that is the form for the buyer to claim exemption from sales tax. Notice there is no block for any information about the seller.

The plates were illegal.

Get your facts straight, everyone responded at Compean's call and before the van was positively identified. Juarez called out the van just as it was entering Fabens proper. And didn't you argue that a high speed chase was improper if not illegal? To explain a general response by the Fabens station based on a high speed chase you would have to admit that the supervisors knew it was a high speed chase.

If a cop tried to split my head open with the butt of a shotgun, I might run as well

Oh so now fleeing in a vehicle is not running to you? The shotgun incident occurred well after Davila began his run. Plus it is preposterous to claim that Compean out of the clear blue decided to bean Davila with no provocation.

Shooting at a perceived threat is justification.

http://www.policeone.com/writers/columnists/Charles-Remsberg/articles/121543-11-years-for-shooting-unarmed-gangbanger-in-the-back/

A California narcotics agent who faced up to 11 years in prison has been found not guilty of voluntary manslaughter for shooting in the back a fleeing suspect who turned out to be unarmed.

A dramatic turning point in the trial came when an expert on the body movements of suspects in deadly force encounters clashed sharply with a prosecutor who claimed the agent lied about how the shooting occurred.

During a cross-examination, Deputy DA Lane Liroff emphatically asserted that the suspect could not have turned and pointed what appeared to be a gun while simultaneously running away, as the agent said he did, without falling down.

"That's the most ridiculous thing I've ever heard!" retorted expert witness Dr. Bill Lewinski of the Force Science Research Center at Minnesota State University-Mankato.

As the jury watched and snickered, Lewinski then sprinted for about 30 feet across the courtroom in the "impossible" posture, without stumbling or falling, thereby puncturing a key component of the prosecution's case.

Unlike you who has called about a dozen other Border Patrol Agents corrupt perjurers on the take, you know, the ones who disagreed with any of the incomprehsible Ramos or Compean testimony.

There you go lying again. I stated that two were liars. They were both fired for lying and they changed their stories numerous times to the prosecution. I did state that the relationship of Rene Sanchez and Davila was "fishy" especially the change meeting at another Mexican city known for its position within a drug corridor. I also used many of the other officers testimonies to support Ramos and Compean's version of the events. I especially noted the testimonies of Yrigoyen and Mendoza.

12 jurors, a 3 judge appeals panel and the entire justice system disagrees with you.

More lies. You can't speak for the entire justice system, plus 3 of the jurors recanted and the 3 judge panel did not review the jury decision they reviewed for "technical" error.

My four handguns, two rifles, two shotguns, 9mm Uzi and Galil. 223 would disagree with you.

I'm happy that your weapons can disagree, but they need a brain to be cogent. I presume you own a television or two, but that does not make you an expert on semiconductor theory.

I'm sorry, are you stating LEO's know the sound of their own weapons?

Tell you what, pick any LEO you want. We will put ear muffs on him/her and then fire two different 40 cal weapons several tens of yards away and beyond a levee. I'll bet the person can't chose his/her own weapon. The fact is Ramos heard shots. He had no positive knowledge as to who was shooting. For all he knew Davila could have wrested the pistol from Compean and shot him with his own pistol. Ramos did not have visual contact with the two while the shots were fired.

Especially when they look like cellphones.

Okay so you want another test? We'll put someone 180 or so feet away and give them unknown to you a cellphone or a 380(or whatever). They get to whirl around and point whatever they have at you. You get one second(generous) to decide what it is.

No, Ramos does not have xray vision but he sure was a hell of a better shot than Compean on that day.

Damn! We actually agree on something.

Yes, and I believe he lied about that.

Well, I don't know what you base that on. Davila testified he did hot look back, and Compean said he was on one knee. So what do you base your belief on? Clairvoyance?

Compean testified about a lot of stuff that seemed at odds with the physical laws of the universe.

Only to someone that knows nothing about the laws of the universe.

Remind me to never take a horse race tip from you.

I'd never give you one. I understand the story about leading a horse to water, you won't drink.

He has Bill Clinton’s shameless capacity for repeating lies even after he has been repeatedly exposed. Anyone who thinks that habit is unique to Democrat sleazeballs just hasn’t been paying attention.
