Thirty-one members of Congress on Wednesday asked President Bush for an "immediate review" of the convictions of former Border Patrol agents Ignacio Ramos and Jose Compean, who were sentenced in 2006 to lengthy prison terms for shooting a drug-smuggling suspect in the buttocks as he fled back to Mexico.
"Should you be unwilling to pardon Agents Ramos and Compean, as some of us have advocated, we ask that you then consider commuting their sentences to time served," the Republican lawmakers said in a letter.
"Your intervention in this matter will not only serve to correct this injustice, but also help reverse the damage these convictions have caused to the men and women of the Border Patrol," the lawmakers said. "Once again, we respectfully request that you intervene on behalf of Agents Ramos and Compean, and remove them from federal custody."

Making up shit again aren't you? The vehicle was sold to a Mexican national by an El Paso dealer. Therefore the Texas plates were illegal. And for not being anything worth catching, the nearly total contingent of the Fabens station was sure interested in something about Davila and his van. Innocent people don't run from border patrol agents. Plus, they wouldn't know anything for sure about Davila until they caught him. This whole event was not made up whole cloth for you to call the border patrol agents idiots. They had good cause to do what they did in the chase despite the monday morning quarterbacking by a prosecution bent on winning. And Ramos had no reason to be pissed off that Davila got away. Plus, I really doubt you have any expertise in the sound of pistol fire. Agents wear ear protection when they fire their pistols and the discharges are not from 50 yards away and on the other side of a levee. And Beretta 40 cals are not the exclusive property of the border patrol and even if they were, officers sometimes get shot by their own pistols when someone takes them away. I do not think that Ramos has X-ray vision so that he could ascertain who shot what at whom. But I do know that Ramos did not testify that he saw Compean on one knee reloading and shooting again. Compean testified he never fired from the second magazine, and Juarez lied about seeing Compean shooting from the second magazine at the top of the levee and fully upright. So stop lying.

Hired by Ramos, detective says he tracked suspect through vehicle
Bonilla said he quickly tracked the vehicle to Jesus Beltran, an El Paso self-employed construction worker who buys and sells used cars to supplement his income. Then Beltran examined photos of the van provided by Bonilla, as well as wrecking company towing records, and identified it as one he purchased in 2004 from an El Paso wrecking lot.
He registered it under his name and kept it for five months, then sold it to a friend in Juarez, Mexico, for $1,300. The Texas plates on the car at the time of the Feb. 17, 2005, drug incident were registered to Beltran.

You have more energy than I do. I don't think there is anything more that can be posted that hasn't been said before. IMO, BobJ will continue to post about the opinion of his phantom attorney friends, misrepresent information about the events, and will ignore all those times he's been proven wrong before (only to take it to yet another thread on another day and make the same baseless remarks in hopes that he won't be challenged.) Then the bantering begins all over.
I'm disgusted by the whole chain of events, particularly the slimy tactics of the prosecutors in railroading the agents with threats and dishonest testimony. To think that this is our "Justice" Department at work bothers me a great deal. From here, I hope that the agents do apply for a pardon and that Judicial Watch (or someone) continue with their efforts to tell the whole story behind the story. I also expect that Feinstein, Cornyn, et al. will move forward with language that clarifies the mandatory sentencing laws consistent with the hearings they held last year. They stated clearly in these hearings that the law was not intended for the purpose to which it was applied in the R&C case. Now that the appeal has been decided, it is obvious that they need to act to prevent future injustices.
The jury was not even allowed to see all of the evidence!!

I have, like you, read the trial transcript and surrounding articles, however, unlike you much has slipped from my memory. However, I thought I recall that the government leaned on some of the other Border Agents to roll on Ramos and Compean. I don't recall if the carrot of amnesty was held out or the stick of prosecution, but there was talk of pressure.
Again, the issue was not so much whether or not the Agents shot Alete-Davila but of the cover-up that ensued. Johnny Sutton restated that again after the Appeals finding. The point that needs attention is the willingness of the prosecutors to bend the truth and to favor an illegal drug smuggler over US Border Agents.
Need I remind you of how quickly Sutton overlooked the mistakes made by US Agents and their operative in the “House of Death” affair. People were not just wounded in that operation, people died!
Sutton's supporters lied to a Congressional committee about Ramos and Comnpean, trying to paint them as rogue agents. Why are they not in jail?
It is easy to sit at a desk with 20-20 hindsight and point out all of the errors made by a couple of hardworking USBP Agents in hot pursuit. The adrenaline was surely pumping. And anyone reading the news knows of the increase in border deaths from well armed drug smugglers. My question is why are we not defending the US borders better? With more agents and more weapons and more technology. But, that is a post for another day.
While you all argue the fine points of this trial, you miss the overwhelming injustice of the way Johnny Sutton prosecuted these two agents and used his power and influence to put them in prison for an unreasonable amount of time. [And one might argue that 23 hours a day in solitary is cruel and unusual, as well.] Sutton has the President's ear and that allows him to continue to besmirch the agents. It is much like our DA Mike Nifong in NC, except Nifong did not have friends in high places and thus was removed for doing stuff very similar to Sutton.
I am at this point disheartened and think that only through massive calls and letters, continuing over time is there even a chance of a commutation. Bush is stubborn and this case is made worse by the fact that Sutton is his pal.
I am further saddened by the prospect of having to choose between two candidates that look to me like more of the same. Both McCain and Obama are stubborn and both think they know better than the American people. The Senate is a very poor breeding ground for presidents! But, that, too, is off Thread.

Hunter has had two years to submit legislation to clarify 924-C, get Ramos and Compean out of prison and protect future LEO’s.

I believe Rene Sanchez acted as a double agent in the Ramos-Compean case, Joe Loya, father of Ramoss wife Monica, told WND. He was doing everything he could to protect his life-long friend, Osbaldo Aldrete-Davila, but at the same time he was working with Johnny Sutton to make sure Ramos and Compean were convicted.
I see. A 2 week trial, unanimous decision by a 12 person jury, confirmation from a 3 judge appeals panel, all of whom were appointed by Ronald Reagan, yet none of that means anything when compared to the emotional response from the father of the accused.
But me get this straight. You are accusing a squeeky clean career Border patrol agent of being dirty and corrupt? Is that how you “support” the Border Patrol?
Seems like all you’re supporting is LEO’s who shoot suspected illegal aliens in the back and everyone else be damned.
