Actually, that is not correct.
A ex-post-facto law can not criminalize an act that was legal at the time of the act, but retroactive benefits and/or relief can certainly be granted by statute, and often are.

I don't trust the Senate. The Dems would simply vote along party lines, and a bad precedent will have been set. Next election, if our guy wins, they'll just disqualify him for no reason, again along party lines. I'm not willing to open that door.
A couple of things should set your mind at ease. The Senate has already expressed the opinion that McCain is a Citizen in a resolution introduced by Senator Patrick Leahy (D-Vt.) and Claire McCaskill (D-Mo.) during April of this year after the first New York Times article. Senators are gutless and would not dare try to declare McCain ineligible, everyone who supports the military would be appalled at the idea that the children of service members serving oversees are ineligible to be President. Would you rather have Code-Pink, ACORN or MoveOn file a lawsuit on Wednesday November 5 asking the courts to declare McCain ineligible? It was Al Gore who thought that courts should pick or President for us after the election was over. Worse he wanted only Democrats on the Florida Supreme Court to make the decision. The Constitution has provisions for resolving election disputes through are elected representatives in Congress. If someone was stupid enough to run for President who was constitutionally ineligible for the Presidency and somehow won a majority of the electoral vote there must be a way to enforce that provision of the Constitution. In accord with constitutional principles that authority should be our elected Congressmen.
