Does Obama’s Official Campaign Sanction Libel?

It has now been two days since we filed an explicit report of libelous content at My.BarackObama.com, which is under the editorial control of the official Obama campaign. There is no question as to whether the entry is libelous, because it levies a false accusation of a crime against an identifiable person (corporate or individual). We are not attorneys but we know that a false accusation of a crime is automatically libel; that is, the plaintiff does not even have to prove that he or it was damaged.

As of today (July 10, 12:25 EST) the libelous material is still present. We must therefore conclude that Barack Obama’s official campaign sanctions and tolerates written defamation on a Web site over which it exercises editorial control.

...This is not the only instance of libelous material that appears at my.barackobama.com. The screen shot of Libel Report #2 names the victim and describes the accusation, so we are not going to post it. This is the third libel report we have filed with the Obama campaign.

As of July 10, 12:30 EST, the libelous material in question is still online. Although the Obama campaign obviously did not create the material in question, it sanctioned (tolerated) its publication on a Web site over which it exercises editorial control. In addition, the material is still present despite explicit reports to its administrators, who cannot even claim that no one brought it to their attention.

It appears that Barack Obama’s official campaign welcomes not only anti-Semitic, misogynist, ageist, and racist (Black Hillary Clinton voters called “House Negroes,” with “Negroes” not being the exact word) hate speech at my.barackobama.com, but actual libel in the form of false accusations of crimes against identifiable individuals and organizations.

Do any attorneys want to weigh in on whether Obama's campaign can be held accountable for the libel that it seems to welcome at MyBO?

Some people at FR have asked us to re-post the material in question, but we are not going to give the libel "legs" by quoting it even for the purposes of condemnation. A keyword search of barackobama.com for the names of prominent people and organizations that Obama's supporters dislike (plus even a few Democrats someone or other dislikes), along with terms like "criminal," "racketeering," and so on will turn up plenty for those who are interested. While it is harder to libel a public figure than a private citizen, it is not impossible, and we think a malicious false accusation of a crime could easily qualify.

The fact that Barack Obama's OFFICIAL CAMPAIGN sanctions (tolerates) the posting of libelous material at its Web site says plenty about its character and that of Barack Obama.
