The company my husband works for was just served with a lawsuit for this. "Doffing and Donning" it is called. The employees suing are also including shower time in their lawsuit.

At this time it is just 5 employees, but according to an article in our local paper last week, the lawyers are looking to make it a class action, which would include all employees whether they agree or not.

My husband and I think it is stupid, because they are not required to change, or shower at work. And the only "outside the norm" pieces of equiptment they wear are shoes with metatarsal guards, and hard hats. They do get extremely dirty in some parts of the plant, but other parts (like where my husband works) is relatively clean and the majority go home to shower.

We will not be party to the suit, but it seems like if it goes class action we have no choice? The firm that is representing the group comes from out of state, and it seems like they have made these type of lawsuits their niche.

It is all part of showing up to work ready to go.

Will those who dress at home get paid?

If the cops win this one, enough cops should be fired to make up the cost, so the taxpayers are not hit with a higher cost.

If you are required to get changed at work you should be paid for the time it takes. If you have the choice of dressing at home, you shouldn’t. Seems simple enough to me....
