I'll admit that our court system is flawed but get raided on a faulty warrant (exclusionary rule exceptions or not) and see how fast a decent lawyer can get that case kicked. Look at Randy Weaver.

Go ask Mrs. Weaver, or Randy Weaver's son, how well a lawyer can defend against an unreasonable search. There are tens of thousands of people who have had their cash or cars confiscated, never to be returned, on the false premise that it was involved in a crime. No charges placed upon the person, only the property.

First off, Randy Weaver never even approached a lawyer. He simply retreated up to his little home on the mountain top and ignored a federal court order to appear. Had he done so with an attorney, his wife would probably be alive today. He was stupid.

But you are correct, nonetheless, about how we've allowed the federal government to run amok with property confiscations that often damage innocent persons. One of the most valuable tools in the federal prosecutors rule book is also the most potentially harmful to the law abiding citizen: RICO statutes. Suppose you're married to a felon but uninvolved and totally unaware of illegal activities. You can still lose everything to a RICO property grab.
