Ted Kennedy has made clear to confidants that when his time is up, he wants his Senate seat to stay in the family - with his wife, Vicki. Multiple sources in Massachusetts with close ties to the liberal lion say his wife of 16 years has long been his choice to continue carrying the family flame in the Senate. Kennedy won the seat in 1962; his brother John held it from 1953 to 1960. Theres no question that hed like Vicki to continue in his seat, said one Massachusetts Democrat with ties to the Camelot clan who spoke to Kennedy recently, before his health crisis. Shes smart, and smart politically.
JFK even shared a mistress with the Mafia. I see nothing admirable in him or Teddy.

If he chooses not to run for re-election, then the voters will choose. Of course, I fully expect the stupid MA voters to do what Kennedy wants them to do out of sympathy.
If he dies while in office, then whatever procedure is in place for replacing elected officials in that particular state will govern. Of course, I expect who ever gets to select the replacement will be stupid enough to abide by Kennedy's wishes.
Either way, we're going to end up with another Mrs Carnahan in office. Fortunately, the people of Missouri regained their senses and tossed her out of office after her first term. I don't believe the voters in MA are that smart. (I mean, they re-elected Ted after he killed Mary Jo, so that ought to tell us something about MA voters.)
You want to make a bet. Kennedy and MA go hand in hand.
To win such a suit you would have to find a judge and jury that could withstand the Kennedy mystique/miasma. Tain't gonna happen, they will start pronouncing their 'r's (Havad = Harvard) first. Besides, all they would have to do is to see the precedents from places like New Jersey, where the NJ Supreme Court allowed the Dems to drop a loser Senate incumbent after the primary. In short, the Dems, as the rightful political officeholder's party, know the golden rule of politics, do whatever you can either get away with or have the lawyers fix later.
In this case of who T.E.Kennedy's successor would be, my vote would have the wife finish his term (2012) and then Joe or Patrick take it from there. With the sheeple in Taxachussetts, it might well give them a century plus control of the seat. After all, it is already 60 years (1952-2012).

Secondly, the quoted person said Kennedy allegedly stated his preference before his illness, so who knows if this was just idle chatter at a cocktail party or what.
Third, what's wrong with someone expressing their desire for who should succeed them in office? (Soon-to-be ex-presidents campaign for their preferred candidate all the time). He didn't say "A Kennedy deserves this seat", or "I get to decide." At most, it appears he said it'd be cool if his wife gets to over where he leaves off.
And finally, there's a long tradition of wives being appointed to fill the unfinished terms of deceased senators. Usually they lose at the next regular election, but it wouldn't be like this was the first time it happened.
People need to lighten up on this one for a bit. The poor man was just diagnosed with a terminal illness a few days ago. Jeez.
Other that being Mrs. Teddy Kennedy, what makes this person qualified and the best candidate to take the swimmers place?

Huh? This is the United States of America, not a decaying old world monarchy, or some sleazy banana republic. Are the people of Massachusetts Kennedy’s vassals, are they his puppets to be manipulated and ordered about? If so, will someone look into the possibility of disenfranchising the ‘territory of Massachusetts?’

Nope. That's how it used to work, but the legislature changed the law to require a special election in order to keep Romney from appointing a successor to John Kerry, who went to Viet Nam (and who was going to the White House, or so they thought).
I suppose, if they hurried, they could change the law back. But I'm not sure they want to. Governor Empty Suit's clout has been on the wane since his election. He couldn't even get that casino bill passed.
Is the MA case any different from NY? There was a long serving Dem Congressman who had anticipated running for the Moynihan seat when it was vacated, but Hillary had other ideas. The woman, knowing her place, stepped aside.
Likewise, Bobby Kennedy took the NY Senate seat when it pleased him.
