Gun Dealer and Mayor Face Showdown

When Mayor Michael R. Bloomberg stood at City Hall two years ago to announce that he had just filed suit against several gun shop owners, mainly in the South, it was in a certain fashion the capstone of a signature campaign. Mr. Bloomberg had already bashed the industry in several angry speeches, gone to Washington to pressure congressmen and lobbyists, and made his war against illegal guns a personal crusade.

Now, however, Mr. Bloomberg is likely to answer verbally — and literally in person — for his personal crusade. City officials said on Wednesday that he was virtually certain to take the witness stand next month at a landmark federal trial resulting from his suit.

As befits a court proceeding stemming from a deeply held conviction, Mr. Bloomberg will find himself confronting, in the defendant, a rather stubborn man of equally firm belief. His name is Jay Wallace, and he is an irascible outdoorsman who owns a sporting goods store in the Atlanta suburb of Smyrna, Ga. With his wife, Cecilia, Mr. Wallace, 51, arrived in New York City earlier this week in advance of the trial, which is to begin on Tuesday.

“I believe that I care more about firearms getting into criminals’ hands than the mayor of New York City does,” Mr. Wallace said on Wednesday at a pretrial conference at the Brooklyn federal courthouse, where the trial will be held. “I’m in the business. I know how my business is run.”

The trial can be read in many ways: as gun victim versus gun seller, as city versus country, as red state versus blue state, and, none the least, as a version of David v. Goliath, with Mr. Wallace in the self-appointed slingshot role.

No, Mr Wallace's position is not "self-appointed", as the NY Slimes so sneeringly puts it-Bloomberg forced him into his role against the mayor of New York City. Mr Wallace was minding his own business, something a Yankee liberal wouldn't understand.

At least the wealthy people on the right do what wealtrhy people are supposed to do, consume, and inject life into the economy by creating more wealth and making no bones about it. The wealthy on the left want to do the above, but they have to try to hypocritically pretend they’re also contributing to the “greater good” by interfering with the lives of the “little people”. I’m fine with rich people, I just wish they’d go spend their money and leave the rest of us alone instead of trying to salve their white liberal guilt at the expense of the rest of us.

Wallace is screwed. He might as well save his money and go on home. He’s got Judge Weinstein, one of the most arrogant, anti-gun judges in the country. Wallace’s attorney needs to ask for either a change of venue or a different judge, or he’s wasting his client’s money.

Weinstein is the judge whose decision was reversed in City of New York v. Beretta U.S.A. Corp., the case I mentioned in my post at no. 8. It's going to be very hard for him to get around it in deciding this case. It looks like Bloomy's going to have to prove Wallace illegally sold a gun to somebody who then used it to commit a crime in NYC, a very tough case to prove.

I disagree. Nothing happened to Bloomberg as a result of this decision. The anti-gunners are waging an "asymetric war" on the rest of us in that there are severe consequences if we lose at any point of the process, but if they lose, there are absolutely NO consequences to them either personal or financial. Not a single penny of Bloomturd's was lost in this. The taxpayers financed all of it. There were no personal consequences to it. Bloomturd didn't lose his NYPD personal protection detail. He doesn't face any compensatory or punative judgements for the trouble he caused. He didn't get tried for treason. So I think the neo national socalist a$$hole did NOT get his head handed to him. We simply didn't get ours handed to us. "we" successfully defended against an attack, but the enemy is out there and still has plenty of assets to renew the fight.

Until there are significant consequences to antigunners for pulling this sort of crap. They will continue relentlessly until one of three outcomes occurs.

It looks like Bloomy's going to have to prove Wallace illegally sold a gun to somebody who then used it to commit a crime in NYC, a very tough case to prove.

Meanwhile, NYC has asked that Wallace not be allowed to mention the Second Amendment. I suppose he'd better not salute the flag, either.

Please understand that NY , like most other states that go “Blue” do so due to major urban influence, while the rural stays Blood “Red” almost to a man.

I am a displaced (happily) NYer, and none of my NY friends or family agree with the NYC or Albany crowd. Rather, we would like to draw a line across So. NY (sullivan county) and secede from that un-holy union with down-staters.

Excellent! Government has unlimited resources to prosecute and confiscate peoples liberty, and now seemingly no consequences for doing so. We the people are being made to pay for our own enslavement. They know this, and few of us seem to. You are 100 % correct.

USC. Title 18. Section 241/242. A Felony conviction carries a minimum of 10 years jail. Max penalty is Death.

You file the charges and I'll co-sign 'em. Of course, getting a DA to get it before a judge could be tricky, but not impossible. Plenty of evidence right here on the Internet for a full conviction of Bloomingidiot.
