Why would you assume that? A new President has a mandate and time to make appointments. He’s the mover. Congress can’t just sit there for years and do nothing.

If Ginsburg were to retire and McLame were to nominate a constructionist like Alito or Roberts and the dems held up the process, who cares? The far left side would have one fewer advocate ... decisions that might have gone 5 - 4 will go 5 - 3. He could tell the leaker that his next nominee will be more conservative than his current one.
If only McLame was a conservative...
