1) McCain won't have any choice in the judges because he'll face an overwhelming opposition in the Senate. Think Bork times 10. He'll be forced to nominate Souters or worse.
2) Likewise on the war, emboldened by their new, big majorities (which McCain will give the Dems, even if he wins), they will de-fund the war or otherwise tie his hands so that he can't possibly win.
Better to let the Dems inherit Medicare, SS, and, yes, Iraq (which a McCain, who has no long-term vision, can't do much anyway) and we'll come back and get CONSERVATIVES to fix it in four years.

He'll be forced to nominate Souters or worse. He won't be forced. He can nominate conservative after conservative, and let the post remain empty as the liberal vote them all down. He won't, though, because in his heart he'd prefer "moderate" (aka they'll vote liberal more than conservative) justices anyway.

So you're a fortune teller too? No one can force him to nominate anyone. Read the Constitution ever? He can nominate conservative after conservative. Do you know how many seats are still open in the 5th and 11th circuits? The supreme court works the same way.
