McCain's Birth Abroad Stirs Legal Debate
The Washington Post ^ | Friday, May 2, 2008; | Michael Dobbs

Posted on 05/02/2008 12:23:20 PM PDT by TexasCajun

The Senate has unanimously declared John McCain a natural-born citizen, eligible to be president of the United States.

That is the good news for the presumptive Republican nominee, who was born nearly 72 years ago in a military hospital in the Panama Canal Zone, then under U.S. jurisdiction. The bad news is that the nonbinding Senate resolution passed Wednesday night is simply an opinion that has little bearing on an arcane constitutional debate that has preoccupied legal scholars for many weeks.

Actually I can see what Dems are up to on this one.

Down the road they will call fair when they run an anchor baby for office

This is a Democrat political stunt.

Exactly. And to put it in even simpler terms so that they can understand it:

Is McCain a naturalized citizen? No? Then he is native born.

Romney standing next to McCain makes McCain look like an old, senile, shriveled up, namby-pamby dwarf. At the very least, McCain would need to stand on a two-foot stool in an overstuffed suit.

McCain should just give up since he has no chance of winning the nomination against Mitt Romney.

Sheesh. No wonder some people call him Myth Romney. Despite spending a mountain of money, Romney got his butt kicked by the "old, senile, shriveled up, namby-pamby dwarf."

I don't think that McCain will pick Romney because other than his checkbook, Romney doesn't bring a lot to the table to help McCain win in November.

of course most libs have NOT read the consitution.

Otherwise, they would not insist that it says what it doesn’t say (right to privacy) and doesn’t say what it says (right to bear arms).

Proof positive that neither of them have ever read the Constitution. Then again, most libs have not.

Hard for a lib to read a moving living object.

Will you be bringing your “Save the Rino” sign to the convention?

There are lots of people I like who I wouldn’t want anywhere near the White House except as tourists. I’ll vote for McCain unless a better alternative presents itself. Just don’t expect me to be “honored” to do it - I’ll be holding my nose all the way.

Why can’t we get someone same to run as a 3rd party candidate, like Ross Perot. /sarc

IIRC, Obama's daddy was a citizen of Kenya. That makes Barry Obama a citizen of both the US and Kenya (maybe that's why he doesn't wear a flag on his lapel!)

Does anyone worry about electing a citizen of Kenya as President of the US?

“… writes that he was born “in the Canal Zone” at the U.S. Naval Air Station in Coco Solo…

Oh man!!! Where can I start!

That above statement contains 2 (two) (dos) lies.

1. U.S. Naval Air station was not an air station. It was a submarine base. To this day, I have never seen a runway in Coco Solo.

2. He could not have been born at Coco Solo (unless his mother gave birth to him out in the front yard) because no hospital existed there at that time. He was born in ’36 and Coco Solo Hospital was built in 1941-1942.

________

“Curiously enough, there is no record of McCain’s birth in the Panama Canal Zone Health Department’s bound birth registers, which are publicly available at the National Archives in College Park. A search of the “Child Born Abroad” records of the U.S. consular service for August 1936 included many U.S. citizens born in the Canal Zone but did not turn up any mention of John McCain.”

Since Goldwater was not voted president, it did not become an issue.

My entire life I’ve been told by everyone who has cared to give an opinion that the child of an American GI, who is born overseas because the GI is stationed overseas, is eligible to run for president. US Military bases are considered to be soverign US territory.

You don't even have to be born on US territory, as long as one or both parents is a US citizen.

The Senate has unanimously declared John McCain a natural-born citizen, eligible to be president of the United States.

They don't have that authority. But offspring of servicement born on US military facilities are citizens.

vote for who you want. Call people RINOs - your issue, and I could care less. If McCain was a Democrat I’d still vote for him.

Let me repeat myself - I am not only honored to vote for John McCain, I am PROUD to vote for him. He’s the best person for this job. I can’t wait to vote for him, actually.

What all this amounts to which the SC will have to sort out is: All U.S. citizens are equal (since we all have to pay taxes), but some U.S. citizens are more equal than others.

Sound familiar?

The key constitutional issue is whether the Canal Zone was part of the United States at the time of McCain's birth.

It seems to me that the key constitutional issue is whether the child by birth, not adoption, of two U.S. citizens is a 'natural-born' citizen.

May I clarify what I just wrote:

No, no foreign person who becomes a U.S. citizen can become president of our country if that person’s parent (or parents) was not U.S. citizens. That fat pinhead jerk in Kalifornia comes to mind.
