Revelations that the March 29 phone call that sparked a raid on a West Texas polygamist compound may be a hoax have led prosecutors to doubt the reason for the original search-and-arrest warrant that granted authorities access to the Yearning For Zion Ranch.

Guys, you can’t prosecute a 18 yr old boy for rape in having sex with his 16 yr old girlfriend, but let this entire FLDS cult off the hook for marrying 14 yr old girls off.

Agreed. If any of the FLDS men are engaging in sex with a girl under the age of consent, it is statutory rape, and the perp should be punished to the fullest extent of the law...and perhaps a little more. But perhaps Texas authorities can do that without breaking up uninvolved families and their children.

how many towers does it take for a call to originate? towers work in relay.

You really don't know how they work. Whenever you open your little phone it pings the nearest tower, when it is on it pings automatically at different intervals, depending upon the phone and it's program, however, it always pings the strongest signal. Computers make cell phones possible, and just like email, cell phones aways leave a traceable path.

They got the warrant in good faith, they had no reason to think the call came from somewhere other than the ranch.

Acting on anonymous callers tip from another state (caller id anyone?) is good faith? Why not insist that those making claims at the very least positively identify themselves?

when the story first broke there where immediate stories here on FR about the defect. Those stories included information about the lawyers waiving the defects.

you are confusing the warrant on observations and the warrant based on the aleged hoaxer.

The lack of logic that you are using is what potentially jeopardizes the criminal case. (not to be confused with the CPS case).

go to “the smoking gun” website and read the five page affidavit for the second warrant. It is clearly a cya affidavit seeking to innoculate defects from the warrant used to enter the property the first time.

sloppy police work and BS to the judge only work to allow the guilty to go free. You have girls who are pregnant. The prosecution has to work correctly in order to proceed with the criminal case.

seriously this news source is just waaaaaay behind in its information.

why not simply enter the accused’s name in the ncic? find out who the probation officer was? TALK to the probation officer?

DISCLOSE that effort to the judge?

Lets also not forget that all more modern cell phones have gps locators for 911 compliance.

Anonymous tips are ok provided corroboration is done. Fake but accurate does not work in the court.

Not really... they give a location based on tower signal strengths and triangulation, it isn’t really “GPS” but it is accurate within a few hundred feet. I don’t know if the information is retained on the towers computer (the same computer that records and reports the “CDR” records for billing) but I would think not as the location would be constantly changing and the amount of data would be large. You can be tracked by this technology anytime your phone is powered on.

Let me explain a bit more... your exact location cannot be determined because outside factors affect the signal strength seen from each tower, if you are within range of only 2 towers you will be reported at BOTH locations where the circles connect... if you pass a metal structure your location will be reported as much closer to the towers that are not on the other side of the metal structure... The other big killer of signal is Pine trees ,, not oak , not Sycamore but Pine... I don’t really know why but Pine trees soak up signal.

I have had to subpoena cell records and toll pass records for cases. They can get pretty detailed if you wish. It would not surprise me if the kept good records in order to deal with all the local, municipal, county, state, and federal wireless taxes. They would problably keep it for the same number of days as 911 recordings (generally 30-90 days). It is just a question of issuing the subpoenas fast enough.

I must say that I agree on this point. If the police have the power to take in this large of a population (as you pointed out)for screening, statistically there will always be law breakers exposed.
I feel bad for the parents and children that have done nothing wrong. They have had their lives turned upside down in this witch hunt.
As far as the children’s services are concerned, I for one cannot agree that mainstreaming the kids into modern life will be doing them any favors. How are they going to ‘unteach’ the children after they watch television ?

She did call the Texas authorities, but it was after the search was started. If you read you will find that those calls were traced to her phone, not the same, unregistered, phone as used by the young girl.

Have you read the law enforcement affidavit from Colorado attached to her arrest warrant? The text below is quoted from the affidavit, which starts at page 30 of the pdf file.

"Sergeant Mandel told Sergeant Velasquez he had been contacted by the Texas Rangers in regard to their investigation into the Yearning for Zion (YFZ) Ranch. Sergeant Mandel related Texas Ranger Brooks Long had advised he had two cellular telephone number listings from the Colorado Springs area (719-351-0913 and 719-243-2866). Sergeant Mandel was aware that the phone number, 719-351-0913, that was possibly related to the reporting party for the YFZ Ranch incident in Eldorado, Texas was also idenitified in a prior CSPD case report."

"On April 14, 2008, I spoke with Texas Ranger Long and confirmed telephone number 719 351-0913 was in fact a local Colorado Springs telephone number associated with Rozita Swinton. I informed Ranger Long that Rozita Swinton was known to make false reports of sexual abuse to the police and other agencies..."

On April 10, 2008 Schleicher County (Texas) Deputy Conner was contacted by someone named "Karen" at the Snohomish County Shelter for Battered Women and advised that a shelter worker, Kelly Clagget, was on the telephone with Sarah Barlow...."

"Clagget stated Sarah Barlow had been calling from the same telephone number each time, which was identified as 719-243-2866. The first call to Snohomish County Shelter for Battered Women was on March 22, 2008. Claggett had several telephone conversations with Sarah Barlow on that telephone number..."

"Contact was made with the Federal Bureau of Investigations (FBI) requesting telephone records for the Nextel telephone number 719-243-2866. The results indicated that the cell phone was registered to Courtney Lamont Swinton...The FBI confirmed through Colorado Springs, Colorado utility records that there was another person with the last name Swinton at the apartment complex: Rozita Swinton...Ranger Kemp was provided a copy of the telephone calls made from the Nextel number and identified the telephone number of the Snohomish County Shelter for Battered Women in Washington (425-252-2873) approximately twenty-eight (28) times from March 29, 2008 through April 12, 2008. Ranger Kemp also observed the telephone number for the Newbridge Family Shelter (325 655 5774) on the telephone records approximately sixteen (16) times from March 29,2008 through April 5, 2008."

"An additional telephone number that had been located that Ranger Long advised had called the Newbridge Family Shelter was 719-351-0913. Ranger Kemp was advised by Ranger Long that Affiant [the Colorado Springs detective writing the affidavit] had several reports regarding Rozita Swinton making flase reports with this telephone number."

According to the affidavit by the Colorado Springs police detective, Swinton first called the women's shelter in Washington state under the name "Sarah Barlow" on March 22nd -- before the raid, and before the first of many calls she made to the Newbridge Family Shelter in Texas. Both phone numbers associated with calls to the Newbridge Family Shelter in Texas by "Sarah Barlow" have been used by Rozita Swinton to make false reports.

Maybe not, cops long ago figured out that informants would inform on hearsay if it was beneficial to their own interests including an agenda. Cops can telephone informants just as easily as visa versa.

You are describing the older tower triangulation system still used in many phones (including mine). Most or all currently manufactured phones are designed around GSM technology (GPS capability). The phone sends raw GPS reception data through the system which is then analyzed remotely to determine location.
