PROVIDENCE, R.I. - Gay couples had to struggle mightily to win the right to marry or form civil unions. Now, some are finding that breaking up is hard to do, too.
In Rhode Island, for example, the state's top court ruled in December that gays married in neighboring Massachusetts can't get divorced here because lawmakers have never defined marriage as anything but a union between a man and woman. In Missouri, a judge is deciding whether a lesbian married in Massachusetts can get an annulment.
"We all know people who have gone through divorces. At the end of that long and unhappy period, they have been able to breathe a sigh of relief," said Cassandra Ormiston of Rhode Island, who is splitting from her wife, Margaret Chambers. But "I do not see that on my horizon, that sigh of relief that it's over."
Over the past four years, Massachusetts has been the only state where gay marriage is legal, while nine other states allow gay couples to enter into civil unions or domestic partnerships that offer many of the rights and privileges of marriage. The vast majority of these unions require court action to dissolve.
Gay couples who still live in the state where they got hitched can split up with little difficulty; the laws in those states include divorce or dissolution procedures for same-sex couples. But gay couples who have moved to another state are running into trouble.

Now let’s have no talk of their being hoist on their own petards and that sort of thing...
It’s just another “back door” to the agenda. They know some states will NEVER recognize gay marriage; so instead of attacking it head on, attack it from another angle, gay divorce. If they can get the divorce recognized, then the state MUST recognize that a legal marriage took existed in the first place. Veeerrryy sneeky.

I can see the basic legal problem with a lesbian "mariage"? If there is no man in the relationship to shaft, how is a divorce possible?
the totally retarded part about this is that there is no such thing as ‘divorce’ since these couples aren’t ‘married’ in these states. If they want to split up, then just F’ing split up!!! What else do you want from the government??? Need to divide your assets? Go ahead. Nobody is stopping them. They can sell real estate or argue over who gets the pet cats but none of this requires the government to consent. Mediators can be hired for this purpose despite there being no civil case filed.
And in most cases divorces get hung up on custody of children. And since that isn’t an issue, just decide who is getting what and shut the F up!!!! If you can’t decide who gets what, hire a arbitrator and agree to Binding Arbitration (just like people do in civil courts everywhere).
All this whining and moaning about not ‘being able to get divorced’ because they are lesbians is nonsense. Virtually all aspects of any divorce are simply divisions of property which don’t legally require even a court approval or involvement. The divorce lawyers would probably love to take on queer clients with or without a ‘divorce’ being legal in the state. Lawyers will bill you whether or not the state legalized gay marriage so feel free to get shafted by them just like straight couples who divorce.
