I wouldn’t step inside the Plaquemines Parish Courthouse for any amount of money. The ghost of Leander Perez still haunts the place.

I stepped into the courthouse on monday. I got invited to the hearing on the constitutionality on that law.

Unfortunately for the offense, they had raised the issue in a memorandum and not via a pleading. The other side brought up three cases - one of the cases specifically stated that a pleading had to be made, that a memoradum would not suffice. So the judge, reluctantly, barred the constitutional arguements.

The offense then asked for 30 days to file a writ with the appeals court to review the judges decision.

The judge agreed.

If they were not just lying about the ‘other’ people who needed this law, I hope the final outcome is that the law remains constitutional, for those that did use it, and the use of it is disallowed in this case because they were not dispossesed by the storm.
