Will they? Ginsburg and Breyer sailed through under Clinton, despite the Clarence Thomas fight. The last time Republicans played hardball with a judge that I can think of was back during LBJ's days with Abe Fortas as chief justice. Burger wasn't much better.
Another problem is that democrats hold a majority in the Senate, and will likely do so barring surprises, until 2012 when the class of 06 is up again. Not a lot of cards right now are in our favor.
I would like to think long term here, but with 6 justices over 70 once we get to January 2009, I can't risk that chance. That's why this Ron Paul voter of all people is going to hold his nose one more time like he did for Bush. At least Bush gave us Roberts and (with a push) Alito.
