Lawyers seek release of former SLA member Sara Jane Olson

Former Symbionese Liberation Army member Sara Jane Olson should be freed from prison immediately because California corrections officials had no authority to re-arrest her after she was paroled last week, her attorneys argued in a court motion filed Tuesday.

The motion filed in Sacramento County Superior Court claims that Olson's due process rights were violated when she was returned to prison Saturday to serve at least another year behind bars.

Olson, 61, was paroled March 17 after serving six years in prison for the attempted bombings of Los Angeles police cars in the 1970s and the shooting death of a customer during a bank robbery in the Sacramento suburb of Carmichael in 1975.

Officials at the state's Board of Parole Hearings say they discovered Friday that they had miscalculated her sentence. Olson must serve another year beyond the six years she has been imprisoned, they said.

She was intercepted at Los Angeles International Airport on Friday night as she was about to fly home to Minnesota, where she had lived as a fugitive for 25 years until she was captured in 1999.

She stayed with her family in the Los Angeles County community of Palmdale before being returned to prison.

"It is beyond dispute that Olson was on parole after her release from prison on March 17, 2008," according to the filing by Olson's attorneys. "Once an inmate is released on parole, the board can only suspend or revoke her parole. It cannot simply arrest her and re-incarcerate her. It has no legal authority to do so."

The motion also argues that the parole board cannot re-arrest Olson solely because it made a mistake. Olson's lawyers ask that the board be ordered to explain how it refigured her parole date.

This sounds like a poor Law & Order script where she should be set free because a clerk at the Dept of Prisons can't add. i.e., Ignore the truth on a technicality.

Even looking at the California authorities in the most indulgent light, they have shown themselves to be pretty incompetent. Terrorists should never see the light of day. And she lived freely for many years.

Isn’t it ironic that a radical left terrorist fled to Rhodesia?

“Due Process?” She was still an inmate, and although the California educated morons in state corrections couldn’t do the math, that’s no reason for this poor excuse for a human being to be released. Considering her association with the SLA, her crimes and her several years of flight, most of us could care less about her supposed life as a mother and wife. Tough! Lock her up until the end date. Yeah, I know, that’s admitting she must face the responsibility for her acts. A lot of the Bay area folks believe someone else is always responsible, not the individuals themselves. Tough!

Olson's rearrest wasn't the result of a clerical error.

The minute that the pardon board and the governor agreed to release Olson early, the CDC switch board lit up in Sacramento. The callers were neither minor political hitters or happy campers. The Austrian backtracked immediately and ordered Olson rearrested on any pretense.

Well, let’s hope they do the math correctly this time, and don’t accidentally credit her for the 5 days she was not incarcerated. That’d put her at March 22, 2009 for a release date.

of the 24 years she was on the lamb, pretending to be
a model liberal in St. Paul.

I agree that she should be paroled. I say parole her when that shooting victim returns to life, and after she has served as much time as that victim spent dead.

That was my first question. It’s probably pro bono volunteers from the ultra-Left National Lawyer’s Guild or the International Association of Democratic Lawyers, which served as a Soviet front group during the Cold War
