Tube inserted into man who refused to give urine sample

KELSO, Wash. -- When a man who was suspected of drunken driving in Longview refused to give blood and urine samples he was taken to a hospital.

His lawyer says he was held down kicking and screaming for a blood draw. And a tube was inserted into his bladder to withdraw the urine.

He sued Cowlitz County. A settlement was reached Friday in which he was paid $15,000, without authorities admitting they did anything wrong.

The 37-year-old man, Matthew Clifford Arthur, was on probation at the time of the arrest in November and was required to undergo screening for drugs and alcohol. When he refused, his lawyer says he should have been taken to the jail instead of the hospital.

I pray for your recovery and commiserate with you. I had a Foley catheter in overnight after some prostate surgery. The next day, the doctor told me to count to three and he would remove it. He got to two and then yanked with all his might, like he was starting a lawnmower. I guess it hurts less that way, or at least for less time.

The article doesn't say why he was on probation.

Doesn't matter - he's ON PROBATION!!!! His butt, his blood and his urine belong to the state in exchange for proving that he can obey the laws of society . . . . . . . . which he obviously can't!

If there was justice in the universe, you’d get the alien anal probe.

Here's a hint - you don't get put on probation for singing off-key in the church choir. He got probation as a second chance to prove that he is an honorable, law-abiding citizen.

This latest arrest proves that he isn't!! He blew it and now he is paying the price of being an ignoramus!!!

IMHO you are ceding too much power to the state. A serious amount of power.

My previous statement stands, until you can’t sit :-)

He can give up ‘privilege's’ not ‘Rights’.

Once you give control of Rights to Gov’t we are screwed. I'm really worried about FR when people are wanting to give up 'rights'. Scary.

Just think if he had been an illegal they probably would have bought him a steak dinner and had a cop drive him home.

“He was on probation. I think he forfeits his right to be outraged “

which one of the 10 bill of rights says that?

He was on probation. I think he forfeits his right to be outraged . . . . . . . . or paid.

NO, the cops are suppose to play by the rules, if the guy broke his pardon he should have been locked up and the matter put before the judge, who could have order the tests.
