KELSO, Wash. -- When a man who was suspected of drunken driving in Longview refused to give blood and urine samples he was taken to a hospital.
His lawyer says he was held down kicking and screaming for a blood draw. And a tube was inserted into his bladder to withdraw the urine.
He sued Cowlitz County. A settlement was reached Friday in which he was paid $15,000, without authorities admitting they did anything wrong.
The 37-year-old man, Matthew Clifford Arthur, was on probation at the time of the arrest in November and was required to undergo screening for drugs and alcohol. When he refused, his lawyer says he should have been taken to the jail instead of the hospital.

I could be wrong, but I thought that you have a right to refuse a blood test, but it is just about the same as a guilty plea. I didn’t think you could be forced.
I have a tube (catheter) inserted into my tool every week for chemotherapy treatment for bladder cancer (the chemo is injected intravesically rather than intravenously, meaning it is injected direct into the bladder through a catheter inserted into the urethra). No anesthesia. Most uncomfortable.

I suppose his probation should just have been revoked rather than the cops forcibly taking a sample, but when he signed all those papers to get out of prison he agreed to random drug and alcohol testing.
$15,000 is a generous settlement under the circumstances.
He was on probation. I think he forfeits his right to be outraged . . . . . . . . or paid.
It’s just another DBM story drumming up sympathy for people who can’t live within the laws of our society.

In this town, you can attract a conviction and probation by watering your grass or not, mowing your grass or not, or having a tree or bush encroaching on the sidewalk or not.
The article doesn't say why he was on probation.
I’m in the Army Reserve and been deployed twice and I have to periodically at random pee in the bottle upon demand to prove my innocence until proven otherwise of illegal drug use and it is an unwelcome invasive procedure and so I say to anyone who complains,
SCREW YOU JACK!! IT’S DRUGGIES LIKE YOU WHO FORCE THE REST OF US TO SUBMIT TO MANDATORY DRUG TESTING!

That is insane, whether he was on probation or not.
By some sort of law, he should just face sanction as if he failed the test.
And who are the sick Orwellian sadists who forced this test anyway? Was it THAT important to get this guys drug results? I bet someone was just getting some sort of perverse pleasure from this.
