If elected president, Hillary Clinton would ask the Justice Department to determine if alleged 9/11 plotters currently held at Guantanamo Bay, Cuba , could be tried in civilian courts or regular military courts rather than face military commissions that have sparked controversy both inside and outside the United States , her campaign says.
Clinton's response to questions about charges filed last week against six Guantanamo prisoners was the most far reaching of the three leading presidential candidates.
Her opponent for the Democratic nomination, Sen. Barack Obama , D-Ill., said that the so-called "high-value detainees'' at Guantanamo should be tried in federal or traditional military courts, but did not say what actions he would take to move the trials.
Republican Sen. John McCain , the likely Republican nominee, said he plans to continue the military commissions even if the detention center in Cuba is closed, as he has advocated.
The Pentagon disclosed last week that it planned to seek the death penalty against six alleged al Qaeda co-conspirators held at Guantanamo Bay on charges that they conspired in the Sept. 11, 2001 terror attacks that killed nearly 3,000 people in New York , Washington and Pennsylvania .
Those trials, however, are unlikely to begin before the end of the Bush administration meaning it will be left to the next president to determine how those cases will be handled....

There are several ways to view this episode. First...President Hillary would have to appoint special US prosecutors...then unseat the entire DOD event underway right now. DOD wouldn’t care one way or another...they are merely taking orders on this anyway.
So now you’d have around 20 special prosecutors appointed by the justice department...and you could figure at least an entire year for them to get onboard and settled into their job before they could try the cases. Because their entire livelihood depends on the length of this episode...their salaries of $120k a year, and their staffs...you can count on this taking a very long, long time to try a case.
You can also count on some state governor organizing his state police and state attorney general at the base where they will land at...and formerly lay charges there in that state against the guy. The DOD guys and the Feds may not hand the guy over...but they can’t really stop any state from laying in charges. If any state resident has had harm brought to him...by any of these characters...then the state can toss on some kinda of charge. I’m guessing Hillary will be very upset by this state action...but its the way things work.
Finally...after three long years in a Fed jail....most of the cases will be tossed out and the guys will then be stuck. Most countries will refuse them back...so then Hillary has to explain to the public why the US has to accept the guy....permanently....as a resident.
Well who knows, maybe if she has Janet Reno authorizing Wesley Clark and the ATF to arrest them, they may never make it to trial.
So she wants to try the 9/11 plotters in the exact same system which let OJ walk scot free?

With ideas like that, is it any wonder her campaign is going down in a ball of fire?
