Murder, hate crime charged in Oxnard school shooting

OXNARD, Calif. (AP) - California prosecutors have upgraded the charges against a 14-year-old accused of shooting a classmate. And they will try him as an adult.
The victim, a 15-year-old, was shot in class Tuesday morning at a junior high in Oxnard. Other students say the victim "freaked out" other boys because he sometimes wore feminine clothing items.
Doctors have declared him brain dead but he remains on a ventilator. A prosecutor says state law allows murder charges to be filed when a victim is declared brain dead.
The murder charge carries a maximum penalty of 25 years to life, with an additional maximum of 25 years for the firearms enhancement and an added one to three years for the hate-crime enhancement.
Oxnard police have not given a motive but said there appeared to be a personal dispute between the two.
Jay Richard Smith, executive director of Ventura County Rainbow Alliance, a nonprofit group which advocates gay and lesbian rights, attended today's court hearing and said his group would be keeping a close eye on the trial.
"This is an equality issue," he said. "Every child should be able to go to school and be safe. We want to make sure that happens."

Sounds like a decent temporary insanity defense. He’ll be convicted as a juvenile and be out at age 18.

So then, will the “other students” be charged with a hate crime as well? Or are they accomplices to conspiracy before the fact for reason of incitement?
And since when does so-called “brain death” allow the charge of murder... the victim is not yet a corpse.

This must be vigorously prosecuted. Otherwise, you never know what might happen next time Rudy Guiliani decides to play “dress up”.
Finally a case where liberals will support the charging a 14 year old as an adult. What hypocrites.

A 17 year old shooting at a cop is a child, a 14 year old shooting at a protected class is an adult.

Is it too much for me to ask homosexual activists to say, “Just charge the kid with what he would have gotten if he’d shot a straight guy. Forget this ‘hate crime’ BS.”
It is also my firm and sincere belief, based on extensive research of the California “justice” system, that had the victim been straight, the kid who shot him would have been charged as a juvenile, if he was charged at all.
One more thing. The homosexual activist groups who are swarming over this case like vultures are disrupting the mourning process for the victim’s family. These groups don’t care about the family at all, they’re only interesting in exploiting this incident for their own political gain. Shame on them.
Unfortunately, the lure of fame and cash will probably tempt the victim’s family away from logic and reason. I feel sorry for them.

Parents should remove their children from the California government schools immediately.
School employees you have only 2 moral choices:.
1) Resist, refuse to implement, and protest the agenda. In other words you will soon be fired.
2) Quit

My wife and I lived in Massachussets... Now we live in Nebraska and the same crap is here too. My wife is a teacher... and she could tell you some stories.
The only way to stop this through the business end of a rifle. That is where we are at. Whether people realize or accept this to be so is another matter.
Walter Williams has suggested that we peacefully secede. I am beginning to think that may be the only solution.
There is still one other measure we can take.
One of the most important weapons for the Marxists are our government schools. Well,conservatives can fight back. Conservatives could use private schools as a weapon against the Marxists.
How?
Conservatives (Christians and non-Christians)should organize private scholarship foundations that would give private vouchers to private schools. They could also sponsor individual teachers who opened mini-schools, one room school houses, virtual schools, tutoring centers, and/or organized homeschool cooperatives.
The private scholarship foundations could inspect and certify the schools and teachers, and test the students. Of course the Constitution, free markets, family values, and Judeo Christian principles would be the foundation of these private schools.
Once students began leaving the government schools, Conservatives could work with the parents to organize a MASSIVE school tax revolt that would permanently shut down the Marxist govenrment indoctrination camps.
Within one generation we would see a righteous army of youth rise up. They would enter the college campuses ready and prepared to take on their Marxist professors. Soon these youth would be in every area of government, the media, the universities, and every corner of business.
We can turn this nation around. If Harvard can have a $35 BILLION dollar endowment, then Conservatives could do this for K-12 education.
By the way, it makes me sick to think of the billions of dollars Conservatives ( Christian and non-Christian) have given to colleges and universities that are essentially Marxist madrassas.
One more thing, these private scholarship foundations could help organize team sports leagues for their students. Conservatives could break the government monopoly on high school team sports that attracts so many athletically gifted kids to the government schools.

Attempts at secession are never peaceful. Moreover the US government would instantly abridge the federal constitution, suspending habeas corpus, as did Lincoln, and violate the spirit of its own golden standard, the Declaration of Independence, which condones and compels the very act of secession. There argument is that ‘E Pluribus Unum’ and the Constitution have effectively nullified any recourse of severance, since the United States is a new creature, greater than the sum of its parts. Also,WE the People gave are consent to the contract, and therefore can only renegotiate terms through the process of Amendment. Secession is no longer an option. The War of Northern Aggression settled that issue in 1865.
If we dare to set-up conservative schools, the individual state governments would find themselves subjected to harsh federal penalties. Under such threat they would force compulsion to state standards and licensing... a practice that occurs now in jurisdictions that permit home schooling.
If any attempt were made at a property tax revolt the governing authorities would set into motion the machinery of tax leans and foreclosure, leading finally into confiscation of assets by an abuse of eminent domain statutes.
Attempts at armed resistance would be futile in the face of overwhelming firepower exercised by the standing armies of both federal forces and the individual state militias, all of which are now under the authority of the central government.
Since “unusually lethal” firearms have been outlawed and confiscated, and all remaining caliber have been ipso-facto registered via various regulatory practices, confiscation would be immediate, followed by imprisonment at one of the many detention centers erected across the nation.
The Department of Homeland Security would then, by force of the Patriot Act, specific executive orders and other Presidential Directives, declare all defiance against the central authority to be an act of terrorism against the sovereign government of these United States, and promptly declare Marshal Law.
