Yes, the list is available for free online, but it’s illegal to use it for commercial purposes. Maybe a small distinction to an individual, but if list brokerage is your business and you want to resell the names on that list to clients for major casheesh, you’d need a legit chain of custody to show how you got it (or you’d be breaking federal law).
That’s way it’s a big deal (and why it would be worth so much to Gupta that Hillary would be willing to give it to him).

I looked it up and McCain only used his as collateral for a loan when his campaign was broke. If the loan is not repaid the collateral goes to the lender - different road, same destination.
