Sobriety check points are just plain wrong. I was arrested for DUI just because I smelled like beer. 3500$ later I cleared my name. I don’t advocate driving drunk, but many times the cops are wrong.

One cannot be lawfully arrested for smelling like beer. That triggers a reasonable suspicion...which allows the officer to make inquiries, and subject you to testing; failure of which will trigger arrest upon probable cause for OUI.

Are you saying it was an unlawful arrest?

Did you refuse a field test? Refuse the breath test when you knew you'd pass it?

I'm curious.
