One cannot be lawfully arrested for smelling like beer. That triggers a reasonable suspicion...which allows the officer to make inquiries, and subject you to testing; failure of which will trigger arrest upon probable cause for OUI.

Are you saying it was an unlawful arrest?

Did you refuse a field test? Refuse the breath test when you knew you'd pass it?

I'm curious.

First of all the police had no interest in lawfull arrest. My lawyer proved that, Second, I didnt take the tests as that is an admisson of guilt. So bottom line, one WAS arrested for Smeelling like beer!
