Are you at all familiar with this case? What do you make of the physical evidence that doesn’t support the case of those who took the property (via a case tried by a former colleague who did not recuse himself)?

If they are going to be given possession of this land, I think they should at least have to pay back all the taxes and care the Kirlins have spent (although I am vehemently against them being given the spoils of the their thievery)

That would be a start. They were offered an easement parallel to their property line, but refused it, so their intentions were definately the destruction of the Kirlin's property, not the access. Yep! They wanted to maintain their "Open Space" view of the mountains. Don't forget, Edie is also part of that Friends of Boulder Open Space (FOBOS) organization.
I smell a scandal brewing.

Personally speaking, I think those in town who are upset about this theft have just discovered their new "landfill".
I don't think a can of garbage should make it anywhere else other than this couple's front yard.

When all is said and done, they and their cohorts should be arrested on charges of conspiracy, collusion, perjury and deprivation of rights under color of law, since all of them are officers of the court.
The State Bar Association refused to countenance ethics charges, so it's up to the people to see that justice is done.
The only good news is that this is doing major damage to the Boulder Democrat Party and the people are finally seeing just how corrupt they and their friends are. A lot of people are going to lose their elections, starting with Judge Klein and Rep. Claire Levy.

He sees no moral nor legal problems using a friendly, co-worker judge to assist in the theft.
