For Lora and Jamey Costner, a $7,854 federal income tax bill is the painful indigestion that followed two unsatisfying servings of identity theft cooked up by two former Koch Foods employees...
The criminal cases involving the Newport married couple and the two illegal immigrants, who IRS records indicate worked for Koch Foods, have been resolved in the court system.
The bitter aftertaste that remains is the unpalatable possibility of having their wages garnished to pay tax bills on income they never earned ...
"The overall burden of it all is crushing us, please help," the Costners wrote in an appeal to U.S. Sen. Bob Corker, R-Tenn. "We have done all we know to do."
Mrs. Costner says she realized the magnitude of the problem in July when the IRS informed her that she and her husband failed to report approximately $30,000 in income they earned at Koch Foods during 2005.
The Costners say its easy to prove they both worked at Wallace Hardware in Morristown during 2005. Relatedly, Mrs. Costner maintains its childs play to prove they never worked at Koch Foods during that year.
The foreshadowing for Mr. Costner materialized in April 2006 when learned that he was in danger of losing his drivers license because of unpaid citations for speeding and driving without insurance.
The traffic stop came at 3 oclock in the morning while Mr. Costner was asleep. Also, the driver reportedly did not speak English.
Police identified Mrs. Costners impersonator as Elizabeth Velasco Bautista, who later pleaded guilty to criminal impersonation...
The interloper in Mr. Costners life was Douglas Valdez, according to Ellis. Ellis says Valdez avoided the identity-theft charge because a judge ruled that it was not a crime to use someones identity to obtain employment.
The Costners remain in IRS legal limbo.

a judge ruled that it was not a crime to use someones identity to obtain employment.
.
The disgusting part of all of this is how the IRS presumes these victims are guilty of tax fraud. The victims must prove themselves innocent.
.
I guess the crime of fraud isn’t what it used to be in some judge’s eyes.
Guilty until proven not guilty.
Of course, there’s nothing to prove but that doesn’t matter. Any agency of the government will take the assets of whoever is there and has assets to be taken. There’s nothing to be had from these illegals and a lot of people would figure it’s easier and cheaper to pay these government goons off than to go through a costly and stressful battle with the government. And the government counts on that. They know they’re wrong, but they want the money from whoever can be put on the hook for it.
It is a problem popping up everywhere. In my hometown a woman received a tax bill for income from working at four construction jobs, which of course she never did.
Perhaps our “compassionate” President should be asked to foot the bills of those harmed by open borders.
And Koch foods will face no legal issues for this?
Maybe Mike Huckabee is needed to celebrate diversity in language and culture. Some cultures simply don’t value tax laws as much as others do.
impeach the judge
Thanks for the ping george76.
“a judge ruled that it was not a crime to use someones identity to obtain employment.”
WTH? This judge is an idiot. And what the heck is Koch Foods doing hiring non English speaking people with the names Costner?
Also, if you read the entire story, another woman from Maine had her identity stolen by someone working at Kochs.
This company needs to be brought to justice. They apparently are hiring illegals using stolen identities.
This town is not far from where I live. It is overrun with illegals.
As soon as my blood quits boiling, I’ll come back and post what I really think about this.
That happened to us for the 2004 filing year. We could not prove a negative and the SOBs just took the taxes from our checking account. This was nothing more than an obscene taking. You can call me a hostile taxpayer on steroids. Watch out Freepers, something really bad is happening when the IRS is given a mandate by our Democratic congress that violates every constitutional and procedural law.
Fixed it for you. These victims are going to literally need the help of God himself to overcome the power of the IRS.
I am looking forward to hearing what you have to say. There is something really “fishy” about Koch Foods and this judge.
Several months ago there was a FR thread about some freepers in Morristown protesting illegals there. I can’t remember the details, and I have to run now to pick up two little girls I’m watching while their parents visit Santa.
Like I said, I have to run, but I read an interesting thread on www.tn.deer.com today about the feds hauling about 200 illegals out of an ElectroLux plant in Tennessee.
The Fair tax would eliminate problems like this.
It wouldn’t solve the Illegal problem though.
