QUANTICO, Va., Dec. 6 (UPI) -- An HIV-infected U.S. Navy chaplain who pleaded guilty to forcible sodomy was sentenced Thursday to serve two years in a military prison.
Lt. Cmdr. John Thomas Lee, 42, of Burke, Va., accepted a plea agreement with prosecutors that suspended 10 years of a 12-year sentence, dismissed him from the Navy and required him to forfeit future pay and benefits, the Baltimore Sun reported.
Lee, a Roman Catholic priest, admitted forcing himself on a gay Naval Academy midshipman whom he counseled and to having sex with an Air Force officer without disclosing he was HIV-positive.
During his court martial at the Quantico Marine Corps base, Lee said he had known he was infected with the HIV, the virus that causes AIDS, since at least 2005, but said he used a condom.
Prosecutors had sought a 15-year sentence for Lee, who was ordained as a priest in 1993 and began serving as a military chaplain in 1996. He had been charged with aggravated assault, indecent assault, fraternization, forcible and consensual sodomy, and conduct unbecoming an officer.
Lee could have been sentenced to life in prison if found guilty of the forcible sodomy charge alone if there were no plea agreement.

Someone better look into the prosecutor who apparently offered up this gift plea bargain. Was there a guilty verdict and THEN a plea deal? Can’t understand this one.

All of the above. The Georgia statute defined sodomy as "a sexual act involving the sex organs of one person and the mouth or anus of another." I believe most state laws had a similar definition.
Laws against consensual sodomy were struck down in 2004, and were seldom enforced before then. The laws against forcible sodomy, or aggravated sodomy as it's called in many jurisdictions, still stand. The difference between consensual and forcible sodomy is like the difference between fornication and rape.

Can always count on folks on these Catholic threads to be judgemental as opposed to encouraging in their Christianity. One of the many reasons I am conflicted. It’s all about absolutes.
The most crucial issue in allowing homosexuals into the military is at the intersection of morale and infection.
The walking blood supply is that blood you get from the buddy in your unit when the bagged supply is unavailable or runs out of your type.
If your buddy is gay, do you want his? If you’re wounded, do you want him working on you? If he’s wounded, do you want to work on him?
They say, “but don’t you screen for Hiv?” Sure. Once every 2 years or so, but even if they did it the week before deployment, gays are notoriously promiscuous and find a way to connect with someone or something somewhere. So far as HIV is concerned, it is virulent and transmissible within a few short weeks. So, screen today, clean today, but dirty in 2 weeks.
And we haven’t mentioned that there’s no screening for other blood-bourne pathogens such as hepatitis, a disease that is also epidemic in the gay community.
So, if you can save his life with your blood, and he can’t save yours with his, what effect will that have on morale?
And if every application of first aid with a bleeding wound is something terrifying, what effect will that have on morale?
The gay general at the Republican so-called debate was a shill for those who don’t care if they kill people.
