Leo Barboza filed the tort claim, a precursor to a lawsuit against a government entity, after he says a Teton County Sheriff’s deputy shot his dog three times. The dog survived and is recuperating.

The Teton County Sheriff’s Office says Deputy Joseph Gutierrez has been suspended while an investigation is being conducted.

The Sheriff's office offered this official response to the dog shooting incident: http://www.citizenlink.org/Stoplight/A000005834.cfm. Obviously, there was a lot of information omitted from the initial story. The dog had attacked a mentally disabled woman on three different dates before the deputy was dispatched to destroy the dog. The dog's owners could still face prosecution for leaving a vicious dog at large. They were warned multiple times and failed to heed the warnings. The woman bitten could also press civil charges against them.
